At its meeting on July 18, 2013, the Council of the City of Bonn adopted the following bylaws on the basis of Section 142 of the German Building Code (BauGB) and Section 7 of the Municipal Code for the State of North Rhine-Westphalia (GO NRW), each in the currently applicable version:
§ 1: Formal definition of the redevelopment area
In order to remedy urban development deficiencies, the area described in more detail under Section 2 is formally designated as a redevelopment area in accordance with Section 142 ( 3) BauGB and is given the name "Bonn Tannenbusch". The area has a total size of around 36.5 hectares.
§ 2: Scope of application
The spatial scope of the redevelopment area is limited as follows.
From the municipal border to Alfter, northern border of the property Schweidnitzer Weg 2 to 12, Waldenburger Ring, eastern border of the building block Hirschberger Straße 58 to 66, southern border Gymnasium Tannenbusch, bridge Agnetendorfer Straße, northern side of the parking lot Stadtbahn stop Tannenbusch-Mitte, northern border of the property Oppelner Straße 126, eastern side St. Thomas-Morus-Kirche, Oppelner Straße, Schlesienstraße, Hohe Straße, north along the eastern boundary of Masurenweg to Chemnitzer Weg, Stadtbahn bridge, south along the route of the HGK (formerly Rheinuferbahn) to Hohe Straße, Hohe Straße, north from Hohe Straße west of the block at Sudetenstraße 63 to 69, Sudetenstraße, Ostpreußenstraße, Oppelner Straße, Hohe Straße, Schweidnitzer Weg.
The "Bonn Tannenbusch" redevelopment area is shown on the site plan attached as an annex. This site plan is an integral part of the statutes.
§ 3: Procedure
The redevelopment measure will be carried out using the simplified procedure in accordance with Section 142 (4) BauGB. The provisions of Section 144 BauGB on projects, divisions and legal transactions requiring approval apply. The application of the third section "Special redevelopment regulations" of Sections 152 to 156a BauGB is excluded.
§ 4: Implementation period
The redevelopment is to be carried out within ten years of the statutes coming into force in accordance with Section 142 (3) BauGB.
§ 5: Entry into force
Pursuant to Section 143 (1) BauGB, these bylaws become legally binding upon their publication in the Amtsblatt of the City of Bonn.
Publication order
The above bylaws are hereby published.
Notes:
Reference is made to the provisions of Section 215 BauGB. Accordingly, any infringement of the procedural and formal regulations specified in Section 214 para. 1 sentence 1 nos. 1 to 3 BauGB and any defects in the weighing-up process pursuant to Section 214 para. 3 sentence 2 shall become irrelevant if they have not been asserted in writing to the City of Bonn within one year of the publication of these bylaws. The facts justifying the violation or defect must be stated.
In addition, it is pointed out that a violation of procedural or formal regulations of the municipal code for the state of North Rhine-Westphalia in the creation of these bylaws can no longer be asserted after the expiry of one year since this announcement, unless
- a prescribed approval is missing or a prescribed approval/notification procedure has not been carried out,
- these Articles of Association have not been duly published,
- the Mayor of Bonn has previously objected to the Council resolution or
- the formal or procedural defect has been notified to the City of Bonn in advance, stating the violated legal provision and the fact that reveals the defect.
The redevelopment statutes together with the site plan showing the boundaries of the area can be inspected during office hours (Monday and Thursday from 8 am to 6 pm and Tuesday, Wednesday and Friday from 8 am to 1 pm) at the Land Registry and Surveying Office of the City of Bonn, Bonn, City Hall, Berliner Platz 2, Floor 7 B (accessible via elevator group 1 or 2).
