1st organizer
The Mayor of Bonn, Bürgerdienste, - Leistungszentrum "Märkte" - is responsible for the organization of the municipal funfair event "Pützchens Markt".
2. purpose of the event
The event serves to entertain visitors. The primary aim is therefore to create an attractive and balanced range of different types of stores. This funfair, which is well-known and popular beyond the borders of Bonn, is intended to attract visitors through the outstanding quality of the stores and the placement of attractive novelties as well as a typical design that does justice to the historical development (e.g. Pluutenmarkt, inclusion of the residents of the access roads to the main area).
3. fixing
3.1 | The "Pützchens Markt" fair is determined in writing in accordance with § 68 II in conjunction with § 69 I GewO. § Section 69 I GewO (Trade, Commerce and Industry Regulation Act) with regard to the subject of the event, time (date), opening hours and location. |
3.2 | The determination shall be made by the end of July of the previous calendar year at the latest. |
4. advertisement placement
4.1 | The advertisement for applications for the "Pützchens Markt" is placed in certain trade journals (Komet and Kirmesrevue) in August of the previous calendar year. |
4.2 | The advertisement will state a deadline, see Section 6.1 (Application deadline), by which the application must be received by the City of Bonn. |
5. application + application documents
5.1 |
A separate application is required for each business and must be sent to the following address: City of Bonn - Office: 33-12-, Berliner Platz 2, 53103 Bonn |
5.2 | The application must include the following documents: |
5.2.1 | Current address of the applicant with telephone contact details and, if available, e-mail address |
5.2.2 | Written first name and surname of the trader, in the case of legal entities: Number of the commercial register entry and name(s) of the person(s) responsible |
5.2.3 | Description of the business, for example

5.2.4 | Space requirements with the exact dimensions of the store (front length and depth) including a true-to-scale floor plan showing the side on which the entrance is located and, if applicable, exact details of any parts of the unit that extend beyond the floor space. |
5.2.5 | Power connection values (to be specified in KW ) |
5.2.6 | Informative and up-to-date images (computer simulated if necessary) of the store or the products to be offered |
5.3 | All applicants must fulfill the legal requirements, approvals and conditions (e.g. trade, building (e.g. building book), safety (e.g. TÜV) and health regulations) required for the business in question and present them on request. |
6. application deadline
6.1 | The closing date for applications for all types of business is September 30 of the previous year; the postmark or, if not available, the postmark of receipt shall apply. If this date falls on a Saturday or Sunday, the following working day shall apply. |
6.2 | Applications not received by the deadline may be excluded from the award procedure without justification (see Section 7). |
6.3 | Subsequent applications may be considered in individual cases if the business would make a significant contribution to the success of the event due to its special attraction or if gaps in the event area have to be filled at short notice as a result of cancellations. |

8. design plan
8.1 | After the end of the application period, the "Markets" performance center shall draw up an administrative proposal for the design plan (main site) of the Pützchens Markt funfair, which the Beuel district council shall decide on at a meeting at the beginning of the event year within the scope of its decision-making authority. |

In order to be able to organize an attractive and balanced funfair for the population in the sense of point 2, the following types of business should be taken into account as far as possible.

9. approval
9.1 | In accordance with § 70 I GewO, applicants are entitled to admission in accordance with the provisions applicable to all event participants. An individual decision on admission and space allocation is made by the "Markets" service center on the basis of the design plan. This decision is made under public law. In addition to admission, the applicant receives a private-law rental contract for the duration of the event. Admission is not transferable. | |
9.2 | If the available space is insufficient, the entitlement to admission is modified by Section 70 III GewO in such a way that applicants can be rejected for objectively justified reasons. In this respect, a selection based on the principle of equal opportunities must be made. The characteristic of local residency is irrelevant. Applicants who are not admitted will receive a written rejection. | |
9.3 |
In the appropriate selection of applications, the following criteria shall form the basis for admission in the order stated, taking into account the principle of market freedom:

The attractiveness can be determined by the following sub-items, among others a) General for all stores:
b) for rides and children's shops
c) for amusement rides
d) Show rides
e) for snacks, drinks, ice cream, confectionery and other sales
f) for gambling, shooting carts and gambling shops

If applications are equally attractive, the principle of "known and proven" applies, which may be reflected in the following sub-items:

Point 3: | If there is equal attractiveness and also equality according to the principle of "known and proven", then the lot decides. | |
9.4 | The organizer should change a minimum quota of 10 percent (if possible from each type of business; see item 8.2) of exhibitors each year so that new applicants also have a chance to prove themselves. If the calculation based on the specified quota results in a value below 1 (e.g. 3 rides = 0.3), this must be taken into account for the following year(s) until the value of 1 is reached or exceeded. | |
9.5 | However, if the organizer can only comply with the minimum quota by compromising its attractiveness, the quota may be undercut in exceptional cases. In this case, the office management must be informed in writing. In addition, the quotas of the exchanged transactions shall be presented in writing in the respective subsequent controlling report of the "Markets" performance center. |

9.6 |
Decisions on admission are made by a committee of six people. This committee consists of two employees of the "Markets" service center (including the department head), the responsible department head, the head of the Beuel district administration office, the head of the city's event coordination department and the head of the public relations department or their respective representatives . Decisions in the committee must be made by majority vote. In the event of a tie, the decision is made by the head of the Citizen Services department or the respective representative. The head of office will be informed immediately of the selection procedure. |

9.7 | Documentation of the selection procedure shall be prepared, signed by the members of the committee and submitted to the responsible department head for information before sending out the acceptances and rejections. The documentation should clarify the discretion exercised by the committee. |
10. entry into force
These guidelines enter into force on the day following their publication.
