At its meeting on June 27, 1996, the Council of the City of Bonn adopted the following main statutes on the basis of Section 7 (3) of the Municipal Code for the State of North Rhine-Westphalia (GO NW) in the version published on July 14, 1994 (GV.NW. p. 666/SGV.NW.2023), last amended by the Act of March 20, 1996 (GV.NW. p. 124/SGV. NW.2023):
§ 1: Name
(1) The city formed by the law on the municipal reorganization of the Bonn area of June 10, 1969 (GV. NW. p. 236) shall bear the name "City of Bonn".
(2) The names of the former towns of Bad Godesberg and Beuel and the municipalities of Buschdorf, Duisdorf, Holzlar, Ippendorf, Lengsdorf, Lessenich, Oberkassel and Röttgen as well as the district of Hoholz shall continue to be used in addition to the name of the City of Bonn.
§ 2: Territory
The boundaries of the area of the City of Bonn are shown on the map below (Annex 1). It extends over the districts of Beuel, Bonn, Buschdorf, Dottendorf, Duisdorf, Endenich, Friesdorf, Godesberg, Holzlar, Ippendorf, Kessenich, Lannesdorf, Lengsdorf, Lessenich, Mehlem, Muffendorf, Oberkassel, Plittersdorf, Poppelsdorf, Röttgen and Rüngsdorf.
§ 3: City districts
(1) In order to ensure greater participation of citizens in the resolutions of the Council, to prepare the fulfillment of local tasks in specially designated areas and to ensure their implementation, to relieve the City Council in the performance of local self-government tasks and to maintain and strengthen the citizens' sense of political responsibility, the city area is divided into the following districts:
- City district of Bonn with the districts of Auerberg, Bonn-Castell, Buschdorf, Dottendorf, Dransdorf, Endenich, Graurheindorf, Gronau, Ippendorf, Kessenich, Lessenich/Meßdorf, Nordstadt, Poppelsdorf, Röttgen, Südstadt, Tannenbusch, Ückesdorf, Venusberg, Weststadt, Bonn-Zentrum;
- Bad Godesberg district with the districts of Alt-Godesberg, Friesdorf, Godesberg-Nord, Godesberg-Villenviertel, Heiderhof, Hochkreuz, Lannesdorf, Mehlem, Muffendorf, Pennenfeld, Plittersdorf, Rüngsdorf, Schweinheim;
- Beuel district with the districts of Beuel-Mitte, Beuel-Ost, Geislar, Hoholz, Holtorf (with Niederholtorf, Oberholtorf, Ungarten), Holzlar (with Gielgen, Heidebergen, Kohlkaul, Roleber), Küdinghoven, Limperich, Oberkassel, Pützchen/ Bechlinghoven, Ramersdorf, Schwarzrheindorf/Vilich-Rheindorf, Vilich, Vilich-Müldorf;
- Hardtberg district with the districts of Brüser Berg, Duisdorf, Hardthöhe, Lengsdorf.
The boundaries of the boroughs and districts are shown on the map below (Annex 1).
(2) Further details on the formation, tasks and responsibilities of the district councils and on the establishment of district administrative offices are regulated in addition to Sections 36 to 38 GO NW by the district statutes of the City of Bonn, which form part of the main statutes (Annex 2).
§ 4: Coat of arms, flag, official seal
(1) The City of Bonn shall have a coat of arms, a flag and an official seal.
(2) The coat of arms shows in a divided shield a black cross in silver (white) at the top and a striding golden (yellow) lion looking upwards in red at the bottom.
(3) The flag is gold (yellow)-red. The broad golden (yellow) center panel is accompanied by two narrow red panels. The flag shows the coat of arms in the center panel.
(4) The official seal shows the coat of arms with the inscription "Stadt Bonn".
§ 5: Designation of the Council and the Council members
(1) The administration of the city is determined exclusively by the will of the citizens.
(2) The citizenry is represented by the Council and the Mayor of Bonn . The Council shall consist of the members of the Council elected by the citizenry.
(3) The Council shall be known as the "Council of the City of Bonn". The members of the Council shall bear the title "Stadtverordnete" or "Stadtverordneter".
§ 6: Mayor of Bonn, honorary and general deputies, deputies
(1) The Mayor of Bonn is the chairperson of the Council. He/she is the representative of the city and represents the Council externally, is responsible for managing and supervising the business of the entire city administration and is the legal representative in legal and administrative matters.
(2) The Council elects honorary deputies to the Mayor of Bonn from among its members. The honorary deputies represent the Mayor of Bonn in the event of his or her absence in the order determined by the election when chairing Council meetings and in representation. They bear the title of mayor. Other council members and district councillors may also be involved in fulfilling the representative tasks of the city by invitation of the Mayor of Bonn, the mayors or the district heads.
(3) The Council elects five aldermen as full-time civil servants.
(4) The Council appoints one alderman as the general representative of the Mayor of Bonn as deputy head of the city administration. This deputy shall bear the official title of City Director.
(5) If the City Director is prevented from deputizing, the other deputies shall take his/her place in the order of their pay grade. If the grade is the same, seniority shall be decisive; if the grade is the same, age shall be decisive.
§ Section 7: Procedure of the Council and the committees
(1) The procedure of the Council and the committees shall be governed by the rules of procedure.
(2) Insofar as the Council has delegated decision-making powers to committees in accordance with Section 41 (2) GO NW, it is entitled to take back the decision in individual cases. This also applies if the decision-making powers have been transferred by statute. The tasks assigned to the respective committee by law remain unaffected.
(3) In the case of the preparation of development plans of spatial significance limited to the city district, the council shall transfer the participation procedure in accordance with § 3 of the Building Code to the district councils by resolution (target resolution). This does not apply if the significance of development plans that are spatially limited to the urban district extends beyond the urban district due to their content. In particular, development plans whose provisions permit the following projects are of significance beyond the municipal district:
- Projects with more than 75 residential units
- Projects with predominantly special forms of housing with more than ten residential units (student housing, hostels for trainees, accommodation for the homeless, etc.),
- Projects with more than 800 square meters of retail space,
- projects with more than 2,000 square meters of gross floor area for commercial use,
- urban construction projects with the exception of the matters mentioned in paragraph 2 letter a,
- projects relating to the city-wide operation of transport and supply networks and city-wide energy generation.
§ 8: Compensation
The reimbursement of loss of earnings and expenses as well as the reimbursement of expenses for members of the Council, the district councils and the committees in accordance with Sections 36 (4), 45 and 46 GO NW are regulated in the compensation regulations for the Council and the district councils of the City of Bonn, which form part of the main statutes (Annex 3).
§ 9: Informing the residents
(1) The Council shall inform citizens in good time about generally significant planning matters and projects of the City of Bonn, for example
- essential contents of urban development planning,
- framework plans for the design of the districts,
- key issues relating to urban transportation,
- important road expansion plans,
- planning, construction, significant changes or closure of important public facilities.
The basis, objectives, purpose and effects as well as, if applicable, alternatives and expected cost contributions by citizens shall be presented.
(2) The information shall be provided by
a. Publication of
- letters to citizens
- brochures
- press releases
b. Public presentation of the planning,
c. exhibitions or
d. public meetings.
(3) The Council or the district representation authorized to decide on the matter in accordance with the district statutes or the specialist committee authorized to do so in accordance with the rules of competence shall decide on the matters in which information is to be provided and on its content and form.
§ 10: Suggestions and complaints (§ 24 GO NW)
(1) The handling of suggestions and complaints within the meaning of Section 24 GO NRW shall be transferred to the Committee for Citizen Participation (hereinafter: Committee) in the case of concerns of city-wide importance. Concerns of city-wide importance are those whose significance extends significantly beyond one borough and/or which must also be considered in a city-wide context due to their potential impact.
(2) The committee determines its opinion on the suggestions and complaints by resolution (approval, rejection, resolution). The administration shall inform the petitioners of the committee's decision.
(3) In the event of a positive resolution (approval of the examination of the matter by the competent political body), the committee shall make a corresponding recommendation to the Council or specialist committee for discussion and decision via the administration (draft resolution).
(4) The handling of suggestions and complaints within the meaning of § 24 GO NRW is the responsibility of the respective district representation for matters whose significance does not extend significantly beyond a city district. The district council adopts its opinion on the suggestions and complaints by resolution. The district administrative offices shall inform the petitioners of the district representatives' decision.
(5) The administration shall examine the admissibility of the submitted suggestions and complaints. Several suggestions and complaints with the same wording or content can be processed together and submitted to the committee or the district representation together. Suggestions and complaints can be rejected without being dealt with by the committee or district council if
- the submission is made anonymously, without naming the person concerned.
- Suggestions and complaints that do not relate to matters concerning the City of Bonn and therefore do not fall within the competence of the City of Bonn. As far as possible, these will be forwarded to the responsible body.
- there is an obviously abusive submission.
(6) The Council's rules of procedure shall apply accordingly to the procedure in detail (if applicable via § 6 of the district statutes).
(7) In addition to § 24 GO NRW, any natural or legal person (e.g. association with legal capacity) or majority of persons (e.g. association without legal capacity) has the right to address the Council, a district council or the administration of the City of Bonn in writing with requests or complaints (Art. 17 GG). The provisions of paragraphs 1 to 6 apply accordingly.
§ Section 10a Citizens' petitions (Section 26 GO NRW)
The decision on an application in accordance with Section 26 GO NRW (preliminary examination of the admissibility of the citizens' petition) is transferred to the main committee.
§ 11: Honorary designations
(1) Citizens who have served as councillors or honorary civil servants for at least three council periods and have retired may be awarded the honorary title of "Stadtälteste" or "Stadtältester" by council resolution.
(2) When calculating the period of time provided for in para. 1, the periods of membership of the municipal representative bodies or as an honorary civil servant in the area of the municipalities merged by the Act of June 10, 1969 shall be included.
§ 12: Participation in meetings
The Mayor of Bonn and the deputies are obliged to attend the meetings of the Council and the main committee. Otherwise, § 69 GO NW applies.
§ 13: Inspection of files
(1) The right to inspect files is governed by Section 55 (2) to (5) GO NRW.
(2) Requests to inspect files must be addressed to the Mayor of Bonn.
§ Section 14: Contracts with council members, members of district councils, committee members and senior city staff
(1) Contracts of the City with members of the Council, the district councils and the committees as well as with senior employees of the City require the approval of the Council.
Senior civil servants in this sense are the Mayor of Bonn, the aldermen, civil servants in the higher civil service and employees in pay group 13 or higher of the collective agreement for the civil service (TVöD) or with comparable remuneration.
(2) Approval by the Council shall be deemed to have been granted for contracts
- which do not exceed the amount of EUR 5,000; in the case of rental agreements or comparable continuing obligations which are concluded for an indefinite period or whose term is longer than one year, an annual amount shall be taken as the basis;
- on the basis of public or restricted invitations to tender, which are concluded following a decision by the authorized committee.
(3) The Audit Office shall submit an annual summary of the contracts pursuant to para. 2 to the Audit Committee.
§ 15: Personnel matters
(1) The Council shall decide on the election, re-election or dismissal of aldermen.
(2) The Mayor of Bonn shall take the decisions relating to civil service law and employment law for all other civil servants and employees, unless otherwise stipulated by law.
(3) For civil servants in management functions within the meaning of Section 73 (3) GO NRW, decisions that change the basic civil service relationship or the employment relationship of a civil servant shall be made by the Council in agreement with the Mayor of Bonn. If no agreement is reached, the procedure set out in Section 73 (3) sentences 3 to 5 GO NRW shall apply.
(4) With regard to the Municipal Facility Management (SGB), which was set up as a municipal facility management company in accordance with the company statutes of December 16, 2003, the authority to hire, hire and promote employees and terminate employment relationships is transferred to the management. Paragraph 2 shall apply in the event that management has not been appointed.
§ 16: Equal Opportunities Officer
(1) The tasks of realizing the constitutional requirement of equal rights for women and men are carried out by an Equal Opportunities Office, which is headed by a full-time Equal Opportunities Officer. The Equal Opportunities Officer is responsible for all matters relating to women in the administration and the local community.
(2) It shall be ensured that the opinion of the Equal Opportunities Office on matters relevant to women is taken into account when forming the administrative opinion. The Equal Opportunities Officer shall receive the documents necessary for the fulfillment of her duties for inspection as well as the information requested by her, provided that there are no data protection or other legal regulations to the contrary. Matters that affect the living and working conditions of women to a greater extent or in a different way than the living and working conditions of men shall be deemed to be relevant to women.
(3) For the purpose of its involvement in accordance with para. 2, the Equal Opportunities Office shall be involved by the Mayor of Bonn in all projects and committees at such an early stage that its initiatives, suggestions, proposals and other opinions can be taken into account.
(4) The Equal Opportunities Officer may attend meetings of the Administrative Board, the Council and its committees in matters relating to her area of responsibility. She shall be given the floor upon request.
(5) The Equal Opportunities Officer may object to the Mayor of Bonn's draft resolutions in matters that affect her area of responsibility; in this case, the Mayor of Bonn or the employees appointed by her must inform the Council, the responsible district council or the committee responsible according to the rules of competence of the objection and its main reasons at the beginning of the discussion.
(6) The Equal Opportunities Office has an independent right to press and public relations work within the framework of corresponding budget appropriations.
§ 17: Integration Council
(1) The Integration Council consists of 27 members. One third of the members of the Integration Council shall be elected from among the members of the Council in accordance with the procedure applicable to the committees and two thirds shall be elected from lists or as individual candidates for the duration of the term of office of the Council (Section 27 (2) sentence 1 of the Municipal Code of North Rhine-Westphalia).
(2) The funds made available to the Integration Council for the performance of its tasks shall be managed in accordance with the budgetary principles of the City of Bonn.
(3) The Integration Council appoints the secretary at the suggestion of the Mayor of Bonn.
(4) The work of the Integration Council is honorary. The members shall receive compensation for their activities in accordance with the provisions of Section 45, with the exception of Paragraph 4 Number 1 of the Municipal Code of the State of North Rhine-Westphalia and in accordance with the provisions of the main statutes of the City of Bonn.
§ 18: Public announcements
(1) Public announcements of the City that are required by law shall be made in the Amtsblatt of the City of Bonn, unless otherwise required by law.
(2) Public announcements in the Amtsblatt of the City of Bonn shall be referred to for information purposes in the weekly newspaper "Schaufenster". The agendas of the council meetings are also published in the newspapers "Bonner Rundschau" and "General-Anzeiger". The agendas of the meetings of the district councils of Bonn, Beuel and Hardtberg are announced in the weekly newspaper "Schaufenster"; the agendas of the meetings of the Bad Godesberg district council are announced in the weekly newspaper "Blickpunkt" (Bad Godesberg edition).
(3) The date of publication of the Amtsblatt is deemed to be the date of announcement.
§ 19: Entry into force
The above statutes are hereby made public. It is pointed out that a violation of procedural and formal regulations of the municipal code for the state of North Rhine-Westphalia (GO NW) in the creation of these bylaws can no longer be asserted after the expiry of one year since this announcement, unless
- a prescribed approval is missing or a prescribed notification procedure has not been carried out,
- these Articles of Association have not been duly published,
- the Mayor of Bonn has previously objected to the resolution on the articles of association or
- the formal or procedural defect has been notified to the city in advance, stating the violated legal provision and the fact that reveals the defect.
