Purpose(s) of data processing

The department "Economic assistance: Assistance in institutions and special forms of housing, assistance with care, funeral costs" of the Office for Social Affairs and Housing processes data for the purpose of performing its statutory tasks in accordance with the German Social Code. It is obliged to provide money, goods and services economically. This includes services for counseling, ending or reducing the need for assistance, in particular by securing a livelihood, granting outpatient and inpatient care assistance or assistance in other life situations, such as funeral costs. In addition, personal data is also processed when claims for reimbursement are made by other service providers or other bodies or to combat misuse of benefits. The same applies to the issuing of certificates. Personal data is also processed for statistical purposes.

Data processing is based in particular on Art. 6 Para. 1 lit. c) and e) GDPR in conjunction with Sections 67 ff. of SGB X, Social Code Book Twelve (SGB XII) and special statutory regulations.

If data is processed on the basis of the data subject's consent, consent can be withdrawn at any time with effect for the future without giving reasons. This does not affect the processing that took place before consent was withdrawn.

Categories of personal data processed

The following categories of data in particular are processed

(a) contact details, e.g.:

File number, surname, first name, date of birth, place of birth, address, telephone number (voluntary information), e-mail address (voluntary information), marital status, nationality, residence status, pension/social security number, bank details.

b) Data on the granting of benefits, e.g:

Proof of income, proof of assets, benefit period, amount, type, accommodation and heating requirements, data on maintenance claims/recourse claims, data on relatives in the case of funeral costs, data on health insurance, pension insurance, long-term care insurance, data on the duration and termination of any employment relationships, enforcement data, data on proceedings under the Administrative Offenses Act (OWiG).

c) Health data, e.g:

Assessments or opinions by the medical service of the Federal Employment Agency, the health department of the City of Bonn, the medical service of the health insurance funds or the medical service of the pension provider, medical reports, medical diagnoses, therapeutic development reports.

Recipients and categories of recipients of the data

The above-mentioned categories of data may be transferred to third parties to the extent necessary and permitted for the purpose of performing statutory tasks, for example

  • Other social benefit providers (e.g. German pension insurance, health insurance, long-term care insurance)
  • Rehabilitation providers within the meaning of SGB IX
  • Tax offices,
  • Customs authorities,
  • Law enforcement authorities and security authorities (e.g. police, public prosecutor's office, Office for the Protection of the Constitution),
  • Courts,
  • employers,
  • training companies,
  • Training/education providers,
  • contract doctors,
  • other third parties such as municipal offices, vehicle registration office, Federal Ministry of Labor and Social Affairs, Federal Central Tax Office, Federal Audit Office, Federal Office for Migration and Refugees,
Processors (IT service providers), landlords (if direct payment is made to them), energy suppliers (if direct payment is made to them), service providers, debt counseling (only with the consent of the data subject(s)), addiction counseling (only with the consent of the data subject(s)), psychosocial support (only with the consent of the data subject(s)).
Duration of storage and retention periods
(from legal provisions such as cash register, commercial, tax law or KGSt recommendations)

Data relating to the claiming of cash benefits and benefits in kind under SGB XII are stored for 6 years after the case has ended. In this context, a case is terminated when the need for assistance has ceased or there is no longer any entitlement to benefits for other reasons, unless special support benefits are granted or legal disputes have not been concluded. The time limit of 10 years is based on the statutory possibility of reclaiming benefits if it becomes known during this period that benefits were wrongly granted.

If a claim by the Office for Social Affairs and Housing (reclaim/reimbursement notice/loan) is still outstanding, the data is stored for 30 years in accordance with the provisions of the Code of Civil Procedure and the German Civil Code, because only then do the claims become time-barred. The period is calculated depending on the enforcement attempt.

The Office for Social Affairs and Housing may also collect personal data from other public and non-public bodies or persons in compliance with the legal requirements. These may be, for example, other social service providers, internal and external authorities within the scope of statutory inspection powers, employers, training companies, contract doctors, providers of measures/education, etc. In addition, personal data may also be obtained from public sources such as the Internet, population registers, commercial registers, land registries, etc.
