At its meeting on June 22, 2020, the Council of the City of Bonn adopted the following rental regulations for the rental of the event rooms in the "Haus an der Redoute", Kurfürstenallee 1a, 53177 Bonn:
1. general
The event rooms on the first floor of the "Haus an der Redoute" may be used for events
- which do not run counter to the special character of the building and
- to the extent that the premises are not used by the City of Bonn
be made available to third parties for a fee. The decision on this shall be made by the head of the Bad Godesberg district administration office. The premises are rented out in accordance with the provisions of these rental regulations. The exact location of the premises is shown in Annex 1 to the usage agreement. The foyer, the corridors, the WC, the checkroom and the kitchen may also be used for their intended purpose. However, the event as such must take place exclusively in the event rooms in accordance with Annex 1.
2. type of use
- The event rooms are available to interested parties who wish to hold cultural and charitable events (e.g. general meetings, lectures). The use must be in accordance with the spatial and technical conditions. Rental for private and commercial events is not possible.
- Use by the organizer is generally limited to the times outside the regular opening hours of the exhibitions in the "Haus an der Redoute" (these are Wednesday to Sunday, 2 pm to 6 pm). Outside these regular opening hours, there is no supervision on site by the district administration office. Instead, supervision must be organized and provided by the organizer.
3. rental
- A usage agreement is concluded for the provision of the rooms to the organizer. These rental regulations are an integral part of the usage agreement.
- The organizer is obliged to specify the type and duration of use, the estimated number of participants, the course of the event and program changes in advance of the rental.
- The event rooms may only be used for the purpose stated in the usage agreement. Any other use is only permitted with the prior written consent of the City of Bonn. In particular, subletting or transfer of use to third parties is generally not permitted; in exceptional cases, the rooms may only be transferred to third parties with the prior written consent of the City of Bonn.
- The event rooms, the kitchen and the ancillary rooms must be left in a clean condition. Any necessary cleaning costs shall be borne by the organizer.
- The organizers of public assemblies must observe the provisions of the Federal Act on Assemblies and Processions (Assembly Act) in the version published on 15 November 1978 (Federal Law Gazette I p. 1789), which was last amended by Article 2 of the Act of 8 December 2008 (Federal Law Gazette I p. 2366).
- If the organizer does not complain about defects when taking over the rental object, the rental object shall be deemed to have been taken over in proper condition, unless the defects in question were not recognizable when the rental object was taken over.
4. remuneration
- The fee for events for which an admission fee is charged is 12 percent of the total income from admission fees, but at least 90 euros.
- For events lasting up to three hours for which no admission fee is charged, the fee is 50 euros.
- If the duration of the event exceeds three hours, an additional fee of 30 percent of the relevant amount in accordance with section 4.1 or 4.2 is payable for each additional hour or part thereof.
- In addition, during the winter months (October 1 to April 30), a heating surcharge of 30 percent of the aforementioned rental fees must be paid.
- An invoice for the user fee will be issued following the event. The invoice is due for payment within 21 working days.
- Other costs and follow-up costs associated with holding the event shall be borne by the organizer.
- The start of the event shall be the time of admission for preparation and the end of the event shall be the time when the last visitor, participant or organizer leaves the premises.
- The fees are rounded up to full euro amounts.
- The fee to be paid is to be understood plus the statutory value added tax. However, it is currently assumed that the VAT exemption regulation § 4 No. 12 a) UStG (Value Added Tax Act) applies.
5. key handover, key return and usage details
The organizer must consult with the Bad Godesberg district administration office regarding the arrangements for handing over/returning keys and usage details. The key must be returned immediately after the event without being asked.
6. liability
- The organizer shall indemnify the City of Bonn and its employees against any claims by third parties - including any legal and ancillary costs incurred - if these arise in connection with the use of the areas and access points provided. This obligation does not apply if and insofar as the organizer is not responsible for the damage.
- The City of Bonn shall only be liable to the organizer for damage to property and financial losses caused by it or its vicarious agents and its personnel in an attributable manner in the event of intent and gross negligence. The City of Bonn shall be liable for personal injury in accordance with the statutory provisions.
- The organizer shall be liable for all damage incurred by the City of Bonn to the premises provided, including furnishings and access routes, as a result of their use in the context of the planned event. This obligation does not apply if and insofar as the organizer is not responsible for the damage. Damage for which the organizer is liable includes, in particular, damage to works of art in an ongoing exhibition, theft by third parties and, in addition, breaches of supervision or duty of care for which the organizer is responsible. The City of Bonn must be notified immediately in writing of any damage incurred. The organizer shall be liable for any loss of keys and damage resulting from keys being passed on to unauthorized persons.
- In order to secure the claims of the City of Bonn and its employees mentioned under points 6.1 and 6.3, the organizer must provide proof of sufficient insurance (sum insured of at least EUR 2.5 million) no later than 14 days before the start of the event.
- In accordance with Section 38 ( 5) of the Ordinance on the Construction and Operation of Special Buildings in North Rhine-Westphalia (SBauVO) of 2 December 2016, the organizer is responsible for fulfilling the operator obligations arising from paragraphs 1 to 4 of Section 38 SBauVO.
- In this context, the organizer is obliged to appoint at least one so-called event manager from its own staff who is present for the entire duration of the event. The names of the responsible persons can be found in Annex 2 to the usage agreement. The persons responsible must be those who have also signed the handover protocol and have been familiarized accordingly with all safety-relevant aspects.
- Together, the persons named in Annex 2 to the usage agreement are responsible for the safe and orderly running of the respective events in compliance with the legal regulations.
- For the duration of the event, the organizer shall be responsible for all event-related traffic safety obligations for the rented rooms, including the necessary access and escape routes (including the obligation to grit and clear). In this context, the organizer must check whether it is necessary to provide a first-aid service on the basis of the risk analysis it has carried out.
- The organizer must ensure that unauthorized persons do not gain access to the building while it is in use.
- Seating must be adapted to the current exhibition. Art objects may only be moved or removed after consultation with the artist.
- Structural alterations in the event rooms are prohibited. It is not permitted to hammer nails into the walls, nor may stickers be affixed to the walls. The existing equipment must be used (hanging systems). Damage will be repaired by the City of Bonn and charged to the organizer. Only water and white wines/sparkling wines may be offered. Food that could cause contamination of the carpet may not be offered.
- The organizer must take all necessary measures to prevent the risk of fire and accidents. In the event of an accident, the organizer must ensure that help can be summoned by telephone. They must find out where the first aid box is located in the building and where a telephone is accessible.
- No flammable liquids may be used. Open fires and candles are prohibited.
- No more than 170 persons (plus admission staff) may be admitted to the event rooms on the first floor of the "Haus an der Redoute" at any one time. The organizer must take appropriate measures to control the number of persons admitted.
- The disposal of waste must be organized by the organizer. The organizer may use the existing municipal waste containers for this purpose. If these are not sufficient, the organizer must provide additional waste containers at his own expense.
- Escape and rescue routes must be observed and kept clear at all times. The roller shutter of the event room facing the inner courtyard must be kept open during the event.
- The persons named in Annex 2 of the usage agreement must familiarize themselves with the local conditions and the locations of the fire extinguishers.
- The existing smoking ban must be observed and enforced.
- The provisions of the NRW State Immission Control Act on noise levels must be complied with.
7. termination
- If the organizer terminates the usage agreement in writing to the Bad Godesberg district administration office no later than seven days before the event, it shall be exempt from paying the fee. If notice of termination is given later, the full fee must be paid in accordance with Section 4 of these rental regulations.
- Both contracting parties are entitled to terminate the rental agreement at any time, i.e. even during the event, without notice for good cause (§ 543 BGB). For the City of Bonn, good cause shall be deemed to exist in particular if
- the intended event is likely to disrupt public safety and order or damage the reputation of the city,
- the organizer uses the event rooms in breach of contract despite a warning or repeatedly and grossly violates these rental regulations and the house rules in any other way,
- the organizer allows the event rooms to be overcrowded,
- the organizer has not provided proof of the required organizer's liability insurance.
In the aforementioned cases of termination by the City of Bonn, the organizer shall not be entitled to any claims due to the premature termination of the contractual relationship.
- In the event of a gross violation or more than three violations of these rental regulations or the respective house rules, the organizer concerned may be excluded from future use by the Bad Godesberg district administration office.
8. entry into force
These rental regulations enter into force on July 1, 2020.
