As an applicant or bidder, you are obliged to provide the required information. If you do not provide this information, your offer/application to participate may be excluded from the further award procedure in accordance with the provisions of public procurement law.

Personal data may be disclosed to other persons or bodies if you have consented to this or the disclosure is permitted by law:

In accordance with the Competition Register Act, the awarding authority reports information on bidders to the Federal Cartel Office (so-called register authority) with regard to existing grounds for exclusion in accordance with Sections 123 and 124 of the Act against Restraints of Competition within the meaning of Section 98 of the Act against Restraints of Competition.

For contracts above EUR 30,000 excluding VAT, the awarding authority asks the register authority whether there are any entries in the competition register for the bidder who is to be awarded the contract. Below EUR 30,000 excluding VAT, the inquiry is at the discretion of the awarding authority.

In accordance with Section 19 (4) of the Minimum Wage Act, the awarding authority requests information from the central trade register in accordance with Section 150a of the Trade, Commerce and Industry Regulation Act for the bidder who is to be awarded the contract for contracts above EUR 30,000 excluding VAT before awarding the contract.

In all award procedures, the characteristics and advantages of the successful bid and the name of the successful bidder must be communicated at the request of bidders who have not been considered for the award.

After carrying out - a restricted invitation to tender without a call for competition (in accordance with UvgO) or a negotiated award without a call for competition (UvgO) in each case from EUR 25,000 excluding VAT for a period of three months or - a restricted invitation to tender without a call for competition (VOB) from EUR 25,000 or a direct award (VOB) from EUR 15,000 for a period of six months, the name of the commissioned company or natural person will be disclosed for each contract awarded in this way.
