Purpose(s) of data processing

The responsible department of the Office for Social Affairs and Housing processes data in the area of housing entitlement certificates, housing placement, inventory and usage control and housing subsidies for the purpose of fulfilling its statutory duties.
Essential legal basis/s
(both in terms of substantive law and procedural and data protection law)

In terms of content, data processing is carried out in accordance with the Act on the Promotion and Use of Housing for the State of North Rhine-Westphalia (WFNG NRW), the North Rhine-Westphalia Income Determination Decree (EEE) and the North Rhine-Westphalia Housing Promotion Regulations (WFB).

In terms of data protection law, data processing is based in particular on Art. 6 para. 1 lit. c) and e) GDPR.

In addition, data processing is also permitted under Art. 6(1)(a) GDPR if the data subject has given their consent.

If data is processed on the basis of the data subject's consent, the consent can be withdrawn at any time without giving reasons with effect for the future. This does not affect the processing that took place before consent was withdrawn.
Categories of personal data processed

The following categories of data in particular are processed by the responsible department in the Office for Social Affairs and Housing:

(a) contact details, e.g.:

File number, surname, first name, date of birth, place of birth, address, telephone number (voluntary information), e-mail address (voluntary information), marital status, nationality, residence status, pension/social security number, bank details.

b) Data to determine income, e.g. :
Proof of income, benefit period, amount, type, accommodation and heating requirements, data on maintenance claims, data on health insurance, pension insurance, long-term care insurance, data on the duration and termination of any employment relationships, enforcement data and proof of assets.

The above-mentioned data categories may be transferred to third parties for the purpose of performing statutory tasks, such as

  • Social benefit providers
  • Courts,
  • employers,
  • training companies,
  • other third parties such as municipal offices, NRW Bank
  • Processors (IT service providers)
  • Landlords/property managers/property owners
Duration of storage and retention periods
(from legal provisions such as cash register, commercial and tax law or KGSt recommendations)

In principle, data is stored for as long as and to the extent that it is required for the completion of tasks.

A storage period of 5 years is specified for data collected in accordance with the WFNG NRW in the context of housing entitlement certificates or housing brokerage.

According to special legal regulations, data can be stored for up to 30 years in the case of subsidy measures.

With regard to further storage, the general provisions of the DSG NRW in conjunction with the Act on the Preservation and Use of Public Archives in the State of North Rhine-Westphalia (Archivgesetz Nordrhein-Westfalen - ArchivG NRW) must also be observed, from which obligations for storage arise.

The Office for Social Affairs and Housing may also collect personal data from other public and non-public bodies or persons in compliance with the legal requirements. These may be, for example, other social service providers, employers, training companies, training/education providers, etc.

In addition, personal data can also be obtained from public sources such as the Internet, population registers, commercial registers, land registries, etc.
