Purpose(s) of data processing

The care authority in the Office for Social Affairs and Housing processes data for the purpose of fulfilling its statutory duties.
This includes the collection and processing of personal data for the lawful and appropriate fulfillment of the care authority's duty to cooperate in the context of the decision of the local court/care court on the appointment of a caregiver.
In addition, the care authority, as the competent authority at the professional caregiver's place of business, processes and stores the data required for the professional caregiver's appointment.
Essential legal basis/s

Data processing is based in particular on Art. 6 para. 1 lit. c) and e) GDPR and the Data Protection Act of North Rhine-Westphalia (DSG NRW) in conjunction with the relevant provisions of the German Civil Code (BGB), the Act on Proceedings in Family Matters and in Matters of Non-Contentious Jurisdiction (FamFG) and the Care Organization Act (BtOG) in conjunction with the Caregiver Registration Ordinance (BtRegV) in the currently valid version.
In addition, data processing is also permitted in accordance with Art. 6 para. 1 lit. a) GDPR if the data subject has given their consent.
If data is processed on the basis of the data subject's consent, the consent can be withdrawn at any time without giving reasons with effect for the future. This does not affect the processing that took place before consent was withdrawn.
Categories of personal data processed

The following categories of data in particular are processed by the care authority / parent authority in the Office for Social Affairs and Housing as part of the tasks specified in the purpose:
(a) Personal data / contact details: First name and surname, date of birth, address, telephone number, e-mail address, fax number, association address if applicable.
b) Data on criminal convictions and financial circumstances: Information from the debtor register in accordance with Section 882b of the Code of Civil Procedure (ZPO), information on entries in the certificate of good conduct in accordance with Section 30 (5) of the Federal Central Criminal Register (BZRG).
c) Additional data for the registration procedure:
On professional qualification u training, declaration on insolvency, criminal or investigation proceedings, on office organization, on currently managed guardianships, on professional liability insurance for professional guardians.
Recipients and categories of recipients of the data

The above-mentioned categories of personal data may be transferred to third parties for the purpose of performing statutory tasks. These are

  • the office of the guardianship authority responsible for the guardianship proposal
  • other parent authorities operating within the jurisdiction of the respective local courts
  • the competent guardianship court(s)
guardianship association (if the guardian is an employee of a guardianship association or, for volunteer guardians, a connection to a guardianship association is mandatory in accordance with Section 22 (2) BtOG)
Duration of storage and retention periods
(from legal provisions such as cash register, commercial, tax law or KGSt recommendations)

The data processed by the guardianship authority / parent authority will only be stored for as long as is necessary to fulfill its statutory duties. Special legal regulations apply here in accordance with the BtOG and the BtRegV:

The following files and electronic files must be kept for a period of ten years after the end of the proceedings:

  1. Files in which an application for registration has been definitively rejected, and
  2. files in which a registration has been revoked or withdrawn with final effect.

With regard to further storage, the general provisions of the DSG NRW in conjunction with the Act on the Preservation and Use of Public Archives in the State of North Rhine-Westphalia (Archivgesetz Nordrhein-Westfalen - ArchivG NRW) must also be observed, which result in obligations to retain data.

Personal data must always be collected from the person concerned.
The guardianship authority / parent authority may also collect personal data from other public and non-public bodies or persons, e.g. from
  • other competent parent authorities
  • competent guardianship courts
  • guardianship associations (if the guardian is an employee of a guardianship association)
In addition, personal data can also be obtained from public sources such as the Internet, population registers, commercial registers.

  • Right to information about the processed personal data
  • Right to rectification of inaccurate data
  • Right to erasure or restriction of data processing
  • Right to object to data processing due to special circumstances
