Restaurants

In addition to a  restaurant license (opens in a new tab), you also need a building permit to operate a restaurant - this also includes beer pubs, beer gardens, snack bars and hotels. This also applies if rooms previously used for other purposes are to be used as a restaurant in the future. You can find out from your landlord or lessor whether a corresponding building permit has already been granted, or you can check this with a corresponding power of attorney using the local archive files.

Special requirements are placed on a restaurant, for example with regard to fire protection and escape routes, toilet facilities and, in particular, immission control. Outdoor restaurants in particular must be considerate of the surrounding uses worthy of protection with regard to the noise emissions associated with them.

Restaurants are not generally permitted in all building areas; for example, in general residential areas, only restaurants serving the area are permitted.
