In addition to a restaurant license (opens in a new tab), you also need a building permit to operate a restaurant - this also includes beer pubs, beer gardens, snack bars and hotels. This also applies if rooms previously used for other purposes are to be used as a restaurant in the future. You can find out from your landlord or lessor whether a corresponding building permit has already been granted, or you can check this with a corresponding power of attorney using the local archive files.

Special requirements are placed on a restaurant, for example with regard to fire protection and escape routes, toilet facilities and, in particular, immission control. Outdoor restaurants in particular must be considerate of the surrounding uses worthy of protection with regard to the noise emissions associated with them.

Restaurants are not generally permitted in all building areas; for example, in general residential areas, only restaurants serving the area are permitted.

As part of a building permit procedure for a restaurant (new construction and conversion, but also the change of use of premises previously used for other purposes), expert evidence must be provided that, on the one hand, the structural sound insulation is in place, but also whether the immission law requirements are complied with.

Particularly in the case of restaurants or discotheques, it is to be expected that increased noise will penetrate into the surrounding area. It is not only music systems that cause noise immissions. Guests also cause noise. In particular, neighbors are also disturbed by the noise emissions generated outside the restaurant, for example by outdoor restaurants, guests chatting and smoking, cars arriving and departing. These emissions are attributable to the restaurant business. A noise protection expert must therefore prove that the restaurant use is not inconsiderate of the surrounding uses worthy of protection.

In addition to the sound that penetrates through the air to the outside, noise is also transmitted inside buildings. It is therefore also necessary to provide expert evidence that the immission regulations are also complied with in relation to structurally connected rooms requiring protection. In this respect, these also supplement the requirements for structural sound insulation in accordance with Section 18 (2) of the state building regulations and DIN 4109.

Avoidance of odor emissions

Building uses must be operated in such a way that no one is unduly disturbed. This also applies in particular to odors from a restaurant or snack bar kitchen. If food is to be prepared in the restaurant, it is necessary to install an exhaust air system and often also a supply air system. To prevent neighbors from being disturbed by smells from the restaurant kitchen, the exhaust air must be routed over the roof ridge. This must be agreed with the building owner. If this is not possible due to the particular structural situation, a ventilation expert can suggest alternatives.

Since the operation of an exhaust air system also requires the supply of fresh air, it is usually also necessary to install a supply air system, as odors and noise can escape through open windows.
