A preservation and design statute serves to preserve the urban development character of an area and can be adopted by the municipality for certain areas worthy of protection.

In accordance with Section 172 of the Building Code, a conservation statute can be formally issued. In conjunction with Section 89 (1) BauModG NRW, additional design regulations can be laid down for the area of application. A preservation and design statute therefore stipulates special regulations for the alteration, construction or demolition of buildings and the protection of significant designs in the townscape. This means that before an object is altered, it is checked whether it, in combination with other structures, characterizes the townscape or landscape and whether the object is of historical or artistic significance.

The aim of a preservation and design statute is to retain historically evolved structures within the statute area. The process of displacing existing groups of properties should be avoided in order to permanently safeguard the special urban development features of Oberkassel. This is intended to protect the characteristic townscape and landscape of the town center. Preservation statutes are valid indefinitely.
