Your social data is collected in order to

  1. you as the applicant, in order to be able to process your application
  2. from you as a third party in order to
  • be able to legally establish paternity or
  • to assert the child's maintenance claim

Your social data will be processed on the basis of Article 6(1)(e) of the General Data Protection Regulation (GDPR) in conjunction with Sections 18(1) and (2), 62(2) of Book Eight of the German Social Code (SGB VIII) in the context of advice and support and in conjunction with Sections 1712 to 1717 of the German Civil Code (BGB), Section 68(1) and (2) of Book Eight of the German Social Code (SGB VIII) in the context of guardianship.

You are obliged to provide your data. This obligation arises for the applicant from Section 60 SGB I and for the person liable to pay maintenance from Section 1605 BGB.

The Specialist Assistance Service processes the following personal data about you:

  • Surname, first names, marital status
  • Date and place of birth, if applicable, nationality, if applicable
  • your address
  • Employer, if applicable, duration, type and scope of employment, if applicable, reason for termination, if applicable, type and duration of receipt of social benefits, if applicable, type and duration of studies
Recipients and categories of recipients of the data
(as a rule)

Your social data will be passed on to

  • if applicable, the birth registry office of the child for entry in the birth register to establish paternity
  • if relevant and necessary, to social insurance providers, job centers, employers in the case of statutory maintenance obligations
  • Courts, if necessary, to assert the child's claims in court
  • the parent who has applied for advice/support or guardianship as the child's legal representative
Duration of storage and retention periods
(from legal provisions such as cash register, commercial, tax law or KGSt recommendations)
Your data will be stored at the Youth Welfare Office for 10 years after collection. The retention periods begin at the end of the year in which the child comes of age.
