Mayor Katja Dörner had objected to the resolution as it violated applicable law. The district committee lacks the necessary decision-making authority for such a resolution, both in terms of the NRW municipal code and according to the district statutes. Accordingly, it decides on the planning, structural design, maintenance, repair and equipment of the pools located in the district. However, determining the opening hours of municipal facilities is a so-called business of day-to-day administration. Unlike the council, the district council cannot delegate this business to itself.
As the district council maintained its decision even after the complaint, the city council must decide in accordance with the municipal code. The municipal code obliges the Mayor of Bonn to object to resolutions passed by a district council if they violate applicable law.
