At its meeting on June 7, 2018, the City Council of Bonn, subject to the recommendation of the Committee for Planning, Transport and Monument Protection of June 20, 2018, on the basis of Section 7 of the Municipal Code for the State of North Rhine-Westphalia in the version published on July 14, 1994 (GV.NRW. p.666/SGV.NRW.2023), last amended by the Act of January 23, 2018 (GV.NRW.p.90) and Section 86 ( 1) No. 1 and No. 2 and (2) No. 1 of the Building Code for the State of North Rhine-Westphalia - State Building Code (BauO NRW) in the version published on March 1, 2000 (GV.NRW. p.256/SGV.NRW 232), last amended by the Act of May 20, 2014 (GV. NRW. p. 294)), and on the basis of Sections 18 and 19 of the Road and Route Act of the State of North Rhine-Westphalia (StrWG NRW) in the version published on September 23, 1995 (GV.NRW p. 1028/SGV.NRW.91), last amended by the Act of November 15, 2016 (GV. NRW. p. 934), the following bylaws have been adopted:
Preamble
The City of Bonn has set itself the goal of making the Bad Godesberg district center more attractive and thus strengthening the district's center for trade and services. The design and advertising statutes are intended to contribute to the improvement of the cityscape, the city identity and the quality of life. This promotes the distinctiveness and individuality of the appearance, which in turn leads to the preservation of the value of the location for trade, services and tourism.
Section One: Objectives and Delimitations
§ 1 Objective
The Bad Godesberg district center occupies a special historical, cultural-historical and urban development position within the city.
Until the municipal reorganization in 1969, Bad Godesberg was an independent town and the center was the central point of contact. Today, around 76,700 people live in the Bad Godesberg district (as at December 31, 2017), for whom the center with its diverse retail offering is an important point of contact.
The design and advertising bylaws are intended to preserve the characteristic cityscape of the Bad Godesberg district center with its evolved building structure and historical significance for the Bad Godesberg district, to improve the cityscape in the center area and to create comprehensible framework conditions for everyone in design issues in favor of equal opportunities for retail establishments.
The area covered by the bylaws is the area of Bad Godesberg's city centre, which is mainly characterized by the fact that the first floor zones are used commercially and the upper floors are used for residential purposes, as well as the corresponding access areas to this central area. There is an urban development context here that should be designed in line with the above objectives. Special requirements are therefore placed on buildings, advertising structures, the public street space and private areas that are actually in general use with the permission of the authorized user(s) (e.g. Altstadtcenter, Arkadia Passage, Fronhof Galeria).
§ 2 Scope of application
(1) These bylaws apply to the center area of the city district of Bad Godesberg. The area of application includes the area of the pedestrian zone, areas that can be included in the narrower central area in terms of urban structure, as well as the central entrance areas to the district center, which have an impact on urban design due to their functional affiliation on the one hand and their location on the other.
(2) The scope of application includes the following buildings

(3) The boundaries of the area of application are shown on a map. This map is part of the bylaws (appendix).
(4) The provisions of these bylaws shall apply as soon as structural installations or advertising structures are to be altered or newly erected within the area of application or other permits are to be granted on public traffic areas or private areas that are actually in general use with the toleration of the person(s) entitled to dispose of them.
§ 3 General requirements for the design
Buildings, advertising structures and other street furniture must be arranged, erected, installed and designed in such a way that their form, scale, structure, material and color do not impair the historical character, artistic character and urban design of the inner city.
Section Two: Requirements for the design of buildings
§ 4 Requirements for the design of facades
(1) In the case of conversions, renovations or similar measures on parts of the building, in particular measures in the first floor zone, the choice of materials and colors must be coordinated with the existing architectural design of the building.
(2) The structure of the first floor zone - in the case of store areas arranged over several storeys, also that of the relevant storeys - must be developed from the façade of the building and refer to the storeys above. The static system resulting from the structural design (e.g. the structure of the first floor zone corresponds to the vertical structure of the upper floors) should be recognizable. Facade pillars must be designed in such a way that a profiled and sculptural shop window structure is created. When redesigning the first floor zone, at least 50 percent of the façade length must be provided with fixed elements.
(3) When coloring new buildings, renovating and maintaining/repairing and redesigning existing buildings, special consideration must be given to the individual architectural elements of the project in question (e.g. no strong color contrasts between individual storeys or bay windows and the main façade). The overall effect of the street space must also be taken into account (e.g. no dissonant coloring compared to the neighboring buildings). In the case of architectural monuments, an original color scheme - after prior color studies - should be aimed for.
Note: A permit under monument law is required for measures on listed buildings.
(4) In accordance with the historical models, facades should always be finished in smooth plaster. Cladding with natural stone or material similar to natural stone is permitted in the first floor area.
(5) The following are not permitted
- the complete opening of the first floor zone by removing the existing vertically continuous, load-bearing elements,
- the complete or partial cladding of building components or façade parts with metal, plastic or glass, unless such materials are present on the upper floors of the buildings and are characteristic of the appearance,
- the façade paint, if the color itself becomes a means of advertising,
- shop fronts that can be opened completely (e.g. horizontal sliding walls, folding doors , etc.),
- "Counter display windows", i.e. a reduction of the first floor to a pure sales counter with street sales,
- Shop windows on the upper floors, if the upper floors are not used as retail outlets,
- Window panes as frosted glass, reflective or mirrored or with masking; escape doors can be made of frosted glass.
- Attachment of fluorescent strips,
- flickering lighting,
- Illumination of the public street space,
- moving advertising by illuminating the façade or parts of the façade (e.g. by projection),
- monitors, screens or similar installed in and on the façade
§ 5 Awnings and canopies
(1) Awnings must match the architecture of the building in terms of color, shape and installation method and must not interfere with neighboring structures. They must be plain-colored and made of fabric, but must not have a
not have a shiny or reflective surface. Color coordination between the façade design and awnings must be ensured. Awning side panels are not permitted. Awnings are generally only permitted in
retractable and extendable type.
(2) Awnings may project a maximum of 1.50 m. A vertical front edge (valance) may have a maximum height of 0.20 m. In principle, a clear height of 2.50 m from the road surface must be maintained. Awnings must always be installed in the window reveals of the first floor shop windows, exceptionally also in the parapet area between the ground floor and first floor. The distance to the neighboring building must be at least the width of the side wall pillars.
(3) Subordinate self-promotion at the edge of the awnings (valance) is permitted.
(4) Canopies may not extend across the entire façade, but must be visible as individual elements and take into account the structure of the building. They are to be installed in the parapet area between the first floor and 1st floor. The maximum projection is limited to 1.00 m. In principle, a clear height of 2.50 m from the road surface must be maintained. The distance to the neighboring building must be at least the width of the side wall pillars.
(5) Canopies are only permitted as transparent constructions made of glass or transparent plastic.
(6) Rescue and delivery routes must be kept clear of any equipment at all times. In some areas of the city center, therefore, only smaller projections of awnings are possible (e.g. Schultheißgasse, Bürgerstraße, Oststraße, Am Michaelshof).
Section Three: Requirements for advertising installations
§ 6 Term advertising installation
Advertising installations within the meaning of these bylaws are all fixed installations that serve to announce or advertise or as a reference to a trade or profession and are visible from the public street. These include, in particular, signs, lettering, painting, illuminated advertising, showcases and pillars, boards and surfaces intended for posters.
§ 7 Approval requirement
(1) After these design and advertising regulations come into force, approval is required from the building supervisory authority for the erection, attachment or modification of advertising structures on buildings, including advertising structures that do not require approval under the NRW Building Regulations (Section 65 (1) No. 33 b and No. 36 BauO NRW).
(2) Signs up to 0.2 m² (equivalent to a sign measuring 40 x 50 cm) that identify the owner and type of business (e.g. doctor's surgery) at the location of their own services are exempt from the approval requirement.
(3) The architectural monuments registered in the statutory area in accordance with Section 3 of the NRW Monument Protection Act are subject to further provisions where applicable.
§ 8 General requirements for advertising installations
(1) Advertising structures on buildings must be designed or installed in such a way that their shape, size, structure, material, color and method of attachment blend in with the appearance of the buildings to which they are attached, the appearance of the surrounding buildings and the appearance of the street and square. Overlaps with architectural elements (e.g. windows, doors, cornices, balconies) are to be avoided.
(2) Advertising systems are generally only permitted on building facades.
(3) With the exception of the following sentence 2, only advertising for one's own business is permitted. Additional advertising with product brands or pictorial representations of such is permitted if these product brands are offered by the business.
§ 9 Requirements for the design of advertising structures
(1) One advertising medium per business establishment is permitted on the building wall; in the case of corner buildings, one advertising medium is permitted on each side of the facade. One cantilever is permitted per building, in the case of corner buildings one on each side of the façade.
(2) Lettering of the business or company name must be attached to the façade in individual letters or individual symbols in a horizontally legible manner. The letters or symbols may not be independently illuminated
illuminated, but at most backlit.
(3) The height of lettering, signs and symbols may not exceed 0.50 m in total and the width of the lettering may not exceed 0.10 m. The entire advertising installation may cover a maximum of 50 percent of the width of the building. For buildings with a street frontage less than 4 m wide, the size of an advertising installation may be up to 75 percent of the width of the building.
(4) Lettering for business operations on the first floor must be placed between the upper edge of the shop window and the lower edge of the window sill on the second floor. Advertising systems for businesses or companies that operate exclusively on the upper floors and whose advertising systems are to be installed above the second floor are only permitted as an exception and must comply with the requirements of paragraphs (2) and (3).
(5) Cantilevers may be designed as follows:
- in sign format
- not independently illuminated
- decoupaged (cut-out) and backlit characters
- non-illuminated background, only illuminated lettering
(6) Cantilevers, including fixings, may not protrude more than 0.80 m in front of the building line, may not exceed a total area of 0.50 m² (without bracket) and must maintain a lateral gap of at least 4.00 m between them. They are to be installed between the upper edge of the shop window and the lower edge of the window parapet of the 1st floor, but up to a maximum clear height of 4.00 m. If the 1st floor or other upper floors are also used for commercial purposes, this height may be exceeded by up to 2.00 m for the cantilevers intended for this use in the building. A clear height of 2.50 m to the road surface and a distance of 0.50 m to the neighboring boundary must be maintained.
(7) In shop windows, a maximum of 20 percent of the window area (including the integrated glass doors) may be pasted, covered or painted over.
(8) Display cases that are not part of the façade or shop window design must be installed flush with the building wall.
(9) In exceptional cases
- individual letters may be illuminated, but only if the stroke width of the letters is a maximum of 5 cm.
- Signs and boxes are permitted, but the lettering must be three-dimensional and designed in accordance with paragraph (2).
- Lettering may be placed on canopies if the canopies are essential design elements of the building and advertising in front of the canopy is not possible due to the insufficient height of the roof.
- Flags, balloons, banners or tarpaulins for events such as company anniversaries, openings, window displays up to a maximum of 40 percent of the area, etc. are permitted a maximum of four times per year for a maximum total of 30 days.
(10) The following are not permitted
- lettering mounted vertically on the façade (climbing lettering)
- light boxes
- Advertising systems with changing, flashing or moving visible surfaces or corresponding moving illuminated lettering (including light projection)
- Large-format prints covering more than 2/3 of the façade (blow-up, megaposter or similar)
- Advertising installations in front of or on architectural structures and subordinate components (cornices, pillars, wall projections, bay windows, balconies, canopies, etc.)
- Acoustic or acoustically supported advertising installations
- figurative objects attached to the façade
- advertising pennants and flags
- illuminated chains, illuminated bands and illuminated contours
- balloon streamers
(11) Christmas lighting does not fall within the scope of these regulations.
Section Four: Requirements for the use of public traffic areas and private areas that are actually in general use with the tolerance of the person entitled to dispose of them (road space)
§ 10 Presentation of goods
(1) Merchandise displays or merchandise stands are permitted up to a maximum distance of 1.20 m in front of the stores.
(2) One merchandise stand or display with a maximum height of 1.50 m and a maximum footprint of 1.50 m² (approx. 1.20 m x 1.20 m) is permitted per façade side and every 8.00 m of first floor frontage or part thereof. Additional superstructures or signs may not protrude beyond this dimension. The total length of the merchandise displays/racks may not exceed 50 percent of the total length of the façade; the entrance areas must be kept clear in all cases. A distance of at least 0.50 m from the neighboring boundary must be maintained.
(3) Merchandise stands with a base area of up to 0.25 m² may exceed the height of 1.50 m.
(4) If the street space permits a larger display or a different position in the street space due to its width and already installed design elements (display cases, etc.), a decision must be made on a case-by-case basis. The displays should be placed at a uniform distance from the façade in each street.
(5) The following are not permitted
- Expansion of the storage space by storing unpacked goods except for delivery purposes
- the placement of transport packaging (pallets, crates, outer packaging, cartons, trolleys or similar).
(6) Exceptions to paragraph (2) may be permitted for the presentation of goods in flower and fruit stores.
§ 11 Advertising media or other movable furniture
(1) Advertising in the street space may only be carried out using the advertising media set up by the contractual partner of the City of Bonn. Banners that are attached to the front of buildings above the street space may only be used for events
- which affect the entire area of the city center (e.g. Sunday shopping) or
- affect entire streets or
- that are of a cultural or sporting nature (e.g. Beethoven Festival, City Festival, St. Nicholas Market). In the case of spatially limited events, banners may only be attached in the planned event area.
(2) The installation of other movable street furniture (waste paper baskets, bicycle stands, other signs, etc.) is the sole responsibility of the City of Bonn and is prohibited to third parties. In particular, it is not permitted to set up
- sidewalk displays (e.g. single stands, folding stands, triple stands, beach banners, advertising columns, banner systems, easels)
- vending machines
- sales boxes
- Figures of any kind with the exception of the Beethoven figures of citymarketing Bonn e.V.
- advertising affixed to the ground
- private waste baskets
- private bicycle stands
- other signs
- the laying of artificial turf, carpeting or other coverings on public areas.
§ Section 12 Party and election advertising
Party information or advertising for events is only permitted on advertising media that have a design quality comparable to the advertising media specified in Section 11 (1).
The regulations do not apply to advertising structures that are installed or erected by political parties on the occasion of elections and votes.
§ 13 Outdoor catering
(1) Outdoor catering areas should have an open, inviting character. To this end, planters with natural plants with a total height of up to 1.50 m may be placed within the approved area.
(2) Outdoor catering areas must maintain a distance of 1.00 m from the neighboring boundary, provided that the neighboring use is not another catering use. If the width of the building is less than 6.00 m, no distance to the neighboring boundary is required. Escape routes must be kept clear at all times.
(3) Menus or daily specials may be displayed separately on a notice board within the approved area or attached to the building wall. The maximum size of the board must not exceed 0.65 m x 1.10 m.
(4) Only one type of chair, table or umbrella of one make is permitted within an outdoor catering area. Care must be taken to ensure that the furniture is of high quality. The material used for tables and chairs must be wood, metal or a high-quality plastic construction.
(5) If the outdoor catering area is shaded by umbrellas, a diameter of 3.00 m applies as standard. If the street space permits, umbrellas up to a maximum diameter of 4.00 m are possible in exceptional cases. The size and shape of the umbrellas depends on the spatial situation. The parasols may not protrude beyond the approved area of the outdoor catering area. The umbrellas must be plain-colored, made of fabric and without advertising print, with the exception of the restaurant name. Parasols in the public street area may only be set up in ground sockets. A permit from the City of Bonn is required for the installation of such sleeves.
(6) The installation of bar counters with a floor area of more than 1.00 m² and similar devices is only permitted as an exception for special events after prior approval.
(7) The dimensions of the approved outdoor catering area must be adhered to.
(8) The following are not permitted
- Sealing off from neighboring buildings or the street by means of partition walls, fences, chains, plants arranged like fences or hedges or the like
- Tents and tent-like structures and conversions
- platform-like structures
- traffic light umbrellas
- Foils or tarpaulins for wind, sun or rain protection for outdoor gastronomy
- the erection of structurally connected table and chair combinations, sofa groups and upholstered furniture
(9) Provided that, for example, there is a risk from delivery or through traffic, point-shaped elements or elements arranged in short sections to mark the boundaries of the outdoor catering areas are permitted.
(10) Failure to comply with the contents and ancillary provisions of the special use permit may result in the revocation of the special use permit at any time. This is without prejudice to the imposition of fines.
(11) The tree beds of street trees must be kept free of any outdoor catering. The area of Moltkeplatz under the lime trees represents a special situation and is suitable for outdoor catering.
(12) Existing outdoor furniture (chairs, tables, umbrellas) that does not comply with the statutes must be replaced with outdoor furniture that complies with the statutes by December 31, 2020.
Fifth section: Exceptions and administrative offenses and consultation group
§ 14 Exceptions
Exceptions may be permitted in individual cases, in particular if
- compliance with the regulations fails due to the structural and spatial conditions of the buildings or the exterior space, or
- the architecture of the buildings and the character of the streetscape permit this or
- the development of a special design address is sought, which is coordinated with the City of Bonn by the relevant merchants' and owners' association or a real estate and location community (e.g. association or according to ISGG NRW) in accordance with the statutes, or
- it involves innovations that were not yet known at the time the statutes were drawn up and therefore could not be taken into account (experimental clause) or
- compliance with the regulations would lead to an obviously unintended hardship.
- advertising for films/events is to be displayed at a cinema/theater.
Neighboring and public interests must not be impaired. The objective of the statutes must be preserved.
§ 15 Administrative offenses
(1) It is an administrative offense within the meaning of § 59 StrWG NRW if anyone intentionally or negligently
- blocks the escape route contrary to § 5 Para. 6 and § 13 Para. 2 Sentence 3,
- contrary to § 10 Para. 1 Sentence 1, places merchandise displays and merchandise stands further into the road space than permitted,
- exceeds the permitted number of merchandise stands or merchandise displays as well as their permitted height, base area or total length, does not keep entrance areas clear or does not maintain the distance to the neighboring boundary, contrary to § 10 Para. 2,
- uses the street space for purposes not permitted under § 10 Para. 5,
- contrary to § 11 Para. 1 and § 12, places advertising media and banners in the street space,
- places other movable street furniture or objects contrary to § 11 Para. 2,
- contrary to § 13 Para. 2 Sentences 1 and 2, does not maintain the required distances for outdoor catering areas,
- contrary to § 13 Para. 3, sets up one or more information boards outside the approved area or more than one information board in the approved area or attaches them to the building wall or exceeds the maximum size of the board.
- uses tables and chairs made of materials other than wood, metal or a high-quality plastic construction in contravention of Section 13 (4) sentence 2,
- sets up sunshades in contravention of the provision in Section 13 (5) sentence 4,
- carries out sunshades contrary to § 13 Para. 5, Sentence 5,
- installs ground anchors without the approval of the City of Bonn, contrary to § 13 para. 5 sentence 6,
- contrary to § 13 Para. 6, sets up bar counters without prior approval,
- contrary to § 13 Para. 8, takes up street space by setting up the objects mentioned there.
(2) It is an administrative offense within the meaning of § 84 Para. 1 No. 20 of the BauO NRW to intentionally or negligently
- fails to coordinate the choice of materials and colors between the first floor zone and the upper floors contrary to § 4 para. 1,
- contrary to § 4 Para. 2, fails to develop a structure for the first floor zone - in the case of store areas arranged over several floors, also for the relevant floors - from the façade of the building,
- contrary to § 4 para. 2, sentence 3, does not erect a sculptural shop window structure,
- contrary to § 4 Para. 2, Sentence 4, provides less than 50 percent of the façade length with fixed elements,
- contrary to § 4 para. 3, does not take into account the individual architectural elements of the project or the overall effect of the street space when choosing the color scheme,
- installs cladding made of materials other than plaster, natural stone or material similar to natural stone in the first floor area contrary to § 4 Para. 4,
- carries out a measure not permitted under § 4 Para. 5,
- attaches or installs awnings contrary to § 5 para. 1 sentences 2 and 4 and para. 2,
- contrary to § 5 para. 3, attaches third-party advertising anywhere on the awning, advertising anywhere other than in the edge area of the awning (valance) or self-promotion in the edge area of the awning (valance) that is not subordinate,
- does not comply with the provisions of Section 5 (4) and (5) regarding the size, material, type and location of canopies,
- erects, attaches or modifies advertising structures on buildings without a permit in accordance with § 7 Para. 1,
- contrary to § 8 Para. 1, installs advertising structures in such a way that they overlap with architectural elements,
- erects advertising structures contrary to § 8 Para. 2 and 3,
- contrary to § 9 Para. 1, Para. 2 and Para. 4, installs advertising media or cantilevers,
- contrary to § 9 Para. 3, exceeds the specified height or font width or exceeds the advertising installation by more than 50 percent, in the case of a street frontage of less than 4 m by more than 75 percent, of the store width,
- contrary to § 9 para. 5 and para. 6, installs cantilevers,
- contrary to § 9 Para. 7, applies, covers or paints over more than 20 percent of the window area (including the integrated glass doors),
- does not install display cases flush with the building wall contrary to § 9 Para. 8,
- carries out advertising that is not permitted under § 9 Para. 10.
(3) The administrative offense can be punished with a fine of up to 1,000 euros in the cases of para. 1 and with a fine of up to 50,000 euros in the cases of para. 2 in accordance with § 84 para. 3 BauO NRW.
(4) This does not affect the punishment of administrative offenses in accordance with federal and state regulations.
§ 16 Consultation group
The application of the bylaws is monitored by a consultation group, which meets at least twice a year at the instigation of the administration and consists of, among others, representatives of the retail trade, the hospitality industry, architects, the advertising technicians' guild and representatives of the street communities as well as members of the city administration. The council and the consultation group, in agreement with the council, can make proposals for changes to the content of the statutes and appoint additional members on their own initiative.
Sixth section: Entry into force
§ 17 Entry into force
The Articles of Association enter into force for an unlimited period on the day following their public announcement.

The above statutes are hereby made public.
It is pointed out that a violation of procedural and formal regulations of the Municipal Code for the State of North Rhine-Westphalia (GO NRW) in the creation of these bylaws can no longer be asserted after the expiry of one year since this announcement, unless
- a prescribed approval is missing or a prescribed notification procedure has not been carried out,
- these Articles of Association have not been duly published,
- the Mayor of Bonn has previously objected to the resolution on the statutes or
- the formal or procedural defect has been notified to the city in advance, stating the violated legal provision and the fact that reveals the defect.

Administrative guideline for the application of the design and advertising statutes for the Bad Godesberg district center
A. Preliminary remark
For economic reasons, the design statutes for the Bad Godesberg district center contain a number of undefined legal terms. These summarize different and, due to technical developments, not finally positively definable facts to generally typified cases.
In order to ensure the necessary certainty in application, in particular the principle of equality in similar cases, but also to enable the necessary differentiated response to different spatial situations and different types of case constellations, it has proved necessary to issue the following implementation guidelines.
The implementation guidelines also contain information on the possibilities and limits for reacting to unforeseeable cases in the statutes, in which deviations from the standard case are to be handled by way of exception.
It is intended that the guidelines will be continuously reviewed for suitability and completeness in the further course of the application of the statutes and adapted if necessary.
B. Specification of the content of the articles of association
B1. Re § 2 - Scope of application
The scope of application includes all spatial areas described in paragraphs (1) and (2), regardless of whether they are developed or undeveloped. The explicit inclusion of undeveloped properties is intended in particular to prevent the historical character, artistic character or urban design of the immediate surroundings from being impaired (e.g. by the erection of large-format billboards).
B2. Re § 4 - Requirements for the design of facades -
In the special case of merging individual buildings into larger utilization units, the character of the original individual buildings should be preserved as far as possible in order to safeguard the building structure, such as in Alte Bahnhofstrasse.
Bahnhofstrasse, for example. In particular, if an entrance is removed, the original façade elements should remain visible as a reminder by structuring the façade accordingly. For the rest, see § 4 (2) of the statutes.
B3. Re § 4 - Requirements for the design of façades -
The integration of small-scale counter systems into a shop window system, which do not violate the fundamental prohibition of a complete counter window enshrined in the bylaws, may be permitted subject to the following reservations:
- Observance of any existing monument preservation concerns and
- Compatibility with the primary public use of the public space in view of the size of the public space in the immediate vicinity and the existing or expected volume of pedestrians and cyclists.
B4. Re § 9 - Requirements for the design of advertising structures -
In connection with the statute's requirement for individual letters, a decision must be made on the backing of carrier plates, which is only permitted as an exception in the statute, in consideration of the significance of a branded corporate design. The exception should be granted if a design appropriate to the brand is otherwise not possible. The aim is to achieve as harmonious a contrast as possible. The exception is limited by the priority of the public-law interests of monument protection(see B2.) and the general prohibition of disfigurement under building law. For the gradation of the assessment procedure for granting the exception, see C1.
B5. Re Section 9 - Sealing off the store from the public space
According to Section 9 of the bylaws, shop windows may only be covered up to a maximum of 20 percent of the surface area. A comparable effect to a sticker is created if a partition is placed directly behind the glass pane facing the public street space. This effect is created by partitions on the first floor, but also on all floors above. In order to achieve the aim of the statutes to ensure the greatest possible opening of stores to the public space, Section 9 must therefore also be applied to such cases of placement behind glass. In particular, large-format pictures or the unrestricted large format of a company's own bold colors are comparable in their effect to the disruptive effect of a corresponding facade painting. (cf. § 4 (5) of the statutes - color as a means of advertising).
In the event that an exception is granted beyond the upper limit of 20 percent contained in the statutes, the following criteria must be met:
- Moving the bulkhead elements away from the façade by at least 60 cm so that a designable gap is created;
- if more than one window axis is partitioned, large-format lettering in one partition only;
- for bulkheads with more than one window axis, choose a background that matches the façade color
B6. Re § 10 - Presentation of goods
In streets that have a special status due to their design, the streetscape and the road surface as well as special design elements to support the uniformity of the street space and have sufficient traffic space, deviations from the prohibition of the statutes to display goods beyond a distance of 1.20 m from the façade may be granted upon application. The application must be submitted by a constituted community of retailers on the street and be in the overriding interest of the street as a whole. B7. Re § 10 - Display of goods - The term "one display of goods" also includes several parts if these together do not exceed a floor area of 1.5 m².
B8. Re § 10 - Presentation of goods -
Postcard stands whose cards exclusively show tourist motifs of the city of Bonn or the surrounding area may be set up in excess of the otherwise permitted floor space due to their predominantly public interest in promoting the city as a whole and the region. A special use permit must be applied for, and the special requirements formulated in the statutes also apply to these installations.
B9. Re § 13 - Outdoor gastronomy - NEW -
Only one type of chair or table is permitted within an outdoor catering area. High and low chairs may be used side by side if they are of the same make and also meet the requirements for high-quality design. The material used for tables and chairs should be a combination of wood, metal or a high-quality plastic construction with a natural look. When selecting tables and chairs, the overall effect of the street space must be taken into account in addition to the material (e.g. no dissonant coloring in relation to the neighboring restaurant).
The quality requirements can be considered fulfilled if, for example
- high-quality materials such as rattan, wicker, wickerwork made of plastic with a natural look, combinations of metal, wood, natural or plastic wickerwork are used and
- the tables and chairs are in good condition.
The quality requirements are not considered to be met if, for example
- inferior material is used, such as furniture made of molded plastic ("monobloc"),
- there are clearly recognizable defects,
- improper repairs have been carried out (e.g. repairs with adhesive tape),
- significant fading or flaking of the material is visible,
- the furniture has masked lettering or is used as an advertising medium
B10. Regarding § 13 - Outdoor catering
If an exception is to be granted to the general prohibition of bar counters laid down in the bylaws, the following conditions apply:
- The prerequisite for the granting of an exception is a special spatial situation, in particular if there is a greater distance between the indoor and outdoor catering areas.
- The counter elements do not exceed the size of serving trolleys or other smaller mobile elements. Here, an upper limit of 1.0 m² floor area applies as the total size for the counter elements of an outdoor restaurant.
B11. Re § 13 - Outdoor catering
Constructively connected table and chair combinations are only permitted as special seating for very young children.
C1. On the examination procedure for requested exceptions to the lettering
On the examination procedure, for example when assessing the corporate design of an advertising installation with regard to granting an exception for the permission of carrier plates for the backing of individual letters for company lettering (see B4.):
- Examination of whether the corporate design must be applied to the advertising installation, as often company-internal uses are only prescribed for correspondence. The applicant is responsible for providing proof;
- Attempt to "translate" the corporate design to the advertising installation in a form that complies with the statutes (often successful to date);
- Reduction of the backing to as delicate a panel support as possible in the color of the façade;
- Minimizing the background to a subordinate edge around the three-dimensional individual letters.
C2. Procedure for other exceptions
The review steps mentioned under C1. also apply mutatis mutandis to other applications for the granting of an exception to the bylaws, in that the necessity is first determined and, following an affirmative decision, the design that is as close as possible to the objectives of the bylaws is selected, which always also takes into account the specific location of the project with regard to its compatibility with the immediate surroundings and the quality objective inherent in the bylaws for the design of the central public urban spaces.
