Purpose(s) of data processing

The specialist unit of the Office for Social Affairs and Housing processes data for the purpose of fulfilling its statutory duties in accordance with the German Social Code.

This includes advisory services (general advice for people aged 65 and over, housing advice, care and social advice) as well as the determination, assessment and identification of necessary care requirements as the basis for granting benefits.

In addition, personal data is processed for statistical purposes and for the recognition and processing of offers for support in everyday life.
Essential legal basis/s

Data processing by the Office for Social Affairs and Housing is based in particular on Art. 6 Para. 1 lit. c) and e) GDPR in conjunction with Sections 67 ff. of the German Social Code Book Ten (SGB X), the German Social Code Book Five (SGB V), the German Social Code Book Nine (SGB IX), the German Social Code Book Eleven (SGB XI) and the German Social Code Book Twelve (SGB XII). Furthermore, data processing is based on the Ordinance on the Recognition of Offers for Support in Everyday Life and Promotion of the Further Development of the Care Structure in North Rhine-Westphalia (Anerkennungs- und Förderungsverordnung -AnFöVO-) and service regulations.

In addition, data processing is also permitted pursuant to Art. 6 para. 1 lit. a) GDPR if the data subject has given their consent.

If data is processed on the basis of the data subject's consent, the consent can be withdrawn at any time without giving reasons with effect for the future. This does not affect the processing that took place before consent was withdrawn.
Categories of personal data processed

In particular, the following categories of data are processed by the Specialist Department for Old Age and Care in the Office for Social Affairs and Housing:

(a) contact details, e.g.:

File number, surname, first name, date of birth, place of birth, address, telephone number (voluntary information), e-mail address (voluntary information), marital status, nationality, residence status, pension / social security number, association name, contact persons*, bank details, personal data of employees (salary accounts) as previously mentioned.

b) Data on the granting of benefits / provision of services, e.g:

Proof of income, proof of assets, benefit period, amount, type, accommodation and heating requirements, data on maintenance claims/recourse claims, data on health insurance, pension insurance, long-term care insurance, data on the duration and termination of any employment relationships, enforcement data, data on proceedings under the German Administrative Offenses Act (OWiG).

c) Health data, e.g:

Expert opinions, statements, diagnoses, discharge reports from responsible medical services (e.g. rehabilitation sector, medical service of the Federal Employment Agency, health authority, medical insurance service of the health insurance company or pension provider, hospitals)

Recipients and categories of recipients of the data

The above-mentioned data categories may be transferred to third parties for the purpose of performing statutory tasks, such as

  • Other social benefit providers (e.g. German pension insurance, health insurance companies)
  • Tax offices,
  • Law enforcement authorities and security authorities (e.g. police, public prosecutor's office, Office for the Protection of the Constitution),
  • Courts,
  • Organizers of measures/education,
  • contracted doctors,
  • other third parties such as municipal offices, Federal Ministry of Labor and Social Affairs, Federal Central Tax Office, Federal Office for Migration and Refugees,
Landlords (if direct payment is made to them), energy suppliers (if direct payment is made to them), debt counseling (only with the consent of the data subject(s)), addiction counseling (only with the consent of the data subject(s)), psychosocial support (only with the consent of the data subject(s)).
Duration of storage and retention periods

The data processed by the specialist department for old age and care will only be stored for as long as is necessary to fulfill the legal requirements. General and internal regulations on file retention apply to the various categories of personal data.

In general, personal data is stored in the specialist department for 10 years.

With regard to further storage, the general provisions of the DSG NRW in conjunction with the law on the safeguarding and use of public archives in the state of North Rhine-Westphalia (Archivgesetz Nordrhein-Westfalen - ArchivG NRW) must also be observed, from which obligations for storage arise.

If the medical service, the health department of the City of Bonn or the medical service of the health insurance company, the professional psychological service of the Federal Employment Agency or the medical service of the pension provider were involved, the data collected by these specialist services will be deleted after 10 years in accordance with the respective professional regulations.

The Office for Social Affairs and Housing may also collect personal data from other public and non-public bodies or persons in compliance with the legal requirements. These may be, for example, other social service providers, contract doctors, providers of measures/education, etc. In addition, personal data can also be obtained from public sources such as population registers.
