One of the tasks of the public health department is to offer advice on the prevention of infectious diseases. This also includes issues relating to home hygiene and pest infestation. The public health department provides initial advice for inquiries and refers the concerns to the relevant competent authorities.
However, the public health department is not responsible for clarifying issues under private law. If it is not possible to reach an agreement on problems and disputes in tenancies through normal discussions, these disputes must be resolved under civil law. In this case, tenancy law applies between tenants and landlords and neighborhood law applies between property owners.
Private living space is protected by constitutional law. This means that every person can decide for themselves how they want to live. Among other things, this also includes cleanliness and the collection of objects. The hurdle for official intervention is therefore set correspondingly high. The authorities can only intervene if there is a clear threat to public health.
