The districts of Bad Godesberg within the scope of these bylaws are characterized in their appearance by individual buildings worthy of preservation, architectural structures worthy of preservation, streetscapes and squares with different histories. The aim of these bylaws is to achieve a harmonious integration into the existing townscape through special design requirements for future structural changes.

The area covered by the bylaws is located in the Bad Godesberg district, Lannesdorf and Mehlem districts. The exact boundaries are shown on the plans attached to these bylaws (Annexes 1, 2). These plans are available for public inspection.

(1) The statutes apply to all buildings in accordance with § 2 Para. 2 BauO NW.

(2) The stipulations in development plans remain unaffected.

The scale and design of structural alterations and new buildings must be adapted to the surroundings and harmonized with the historic buildings in such a way that the impression of the streetscape as it has historically evolved is preserved. The following requirements in particular must be taken into account:

1. Façade design
   The design of façades visible from public traffic areas is only possible with exposed brickwork, plaster or half-timbering and natural stone. Other materials (e.g. exposed concrete) are permitted as an exception.
2. Roof shapes and ridge directions
   Roof shapes and ridge directions must be designed in such a way that the roofscape defining the respective street is preserved for the buildings and parts of buildings facing the public thoroughfare. Flat roofs are only permitted as an exception for parts of buildings at the rear.
3. Fire walls and fire gables
   Fire walls and fire gables must be adapted to the facades visible from the public traffic area.
4. Garage storeys
   Garage storeys are excluded; garages on the first floor with several adjacent driveways are also excluded.

Building distances and spacing areas may be less than those prescribed in Sections 7 and 8 (2) BauO NW or in the Ordinance on Building Distances and Spacing Areas (Spacing Areas Ordinance) of March 20, 1970 (GV. NW. p. 249/SGV. NW. 232). The extent of the undercutting depends on the respective existing local conditions.

In order to enable a speedy assessment of the urban planning aspects, in particular the harmonious conformity of a building project with the streetscape, the building permit documents - with the exception of the structural engineering documentation - must be submitted in triplicate. When presenting the views, the facades of the directly neighboring buildings must be shown in detail; this can also be done using photographs.

Exceptions and exemptions are governed by Sections 86 (1) and (2) and 103 (4) of the BauO NW.

Any person who intentionally or negligently violates the provisions of §§ 4 and 5 is in breach of the regulations in accordance with § 101 Para. 1 No. 1 BauO NW. The administrative offense can be punished with a fine of up to 25,564.59 euros in accordance with § 101 Para. 3 BauO NW.

These Articles of Association shall enter into force on the day following their public announcement.

The above statutes approved by order of the District President in Cologne dated January 20, 1983 are hereby published. The plans referred to in § 2 are available for public inspection during office hours in the City Hall, Berliner Platz 2, elevator 2, floor 8 C.

It is pointed out that a violation of procedural and formal regulations of the municipal code for the state of North Rhine-Westphalia (GO NW) in the creation of these bylaws can no longer be asserted after the expiry of one year since this announcement, unless

1. a prescribed approval is missing,
2. these statutes have not been duly published,
3. the Chief Town Clerk has previously objected to the resolution on the statutes or
4. the formal or procedural defect has been notified to the city in advance, stating the violated legal provision and the fact that reveals the defect.
