Severely disabled persons - personal parking space

Overview

In justified exceptional cases, the provisions of the Road Traffic Regulations (Section 45 (1b) No. 2 StVO) allow a parking space for the severely disabled to be set up in front of the home or workplace.

The arrangement of a personal parking space for the severely disabled requires a special examination. As every road user has the right to basically free parking in public traffic areas, restrictions for the general public must be handled with restraint. The need to set up a personal parking space for the severely disabled cannot therefore be justified solely on the basis of the fact that a person has a severe disability.

Among other things, it must be examined whether a special parking right is necessary at all and whether it is justifiable from a traffic perspective. This is not the case, for example, if there is no shortage of parking space or if there is a garage or a parking space outside the public traffic area within a reasonable distance.
