In principle, urban green spaces are used for recreation, leisure activities, to promote the urban microclimate, as a garden substitute and to protect flora and fauna. With a few exceptions, urban green spaces are not designed or suitable for other uses, such as holding events (special uses). However, special use of these areas may be permitted by way of exception if, for example, there is a particular public interest and the impact on the area is technically justifiable in the individual case or in several cases within a period of one year.

Unless special regulations exist (e.g. contract with Deutsche Städtereklame GmbH, tariff regulations for exhibitions, weekly markets, annual markets, Christmas markets and similar events in the City of Bonn), these usage and fee regulations apply to all public green spaces in the area of the City of Bonn, insofar as they have been developed and handed over as such. The Usage and Fee Regulations do not apply to areas that are part of dedicated or actually public roads, paths and squares (e.g. roadside greenery) or for which such use is planned in the future.

A usage permit will only be granted upon written application, which must be submitted by the applicant (usually the contractual partner) to the City of Bonn, Servicebetrieb Stadtgrün, 53103 Bonn, at least four weeks before the intended use (event), stating the location, type, scope, duration of use and the contractual partner/person liable for payment.

Permission is granted by means of a contract of use that regulates at least the following points:

• Type of use
• Duration of use
• Area used
• Documentation of condition
• Liability for any damage caused (insurance if applicable)
• Security deposits
• Amount of the usage fee in accordance with section 6 (fee tariff)
• Regulation on the billing of energy consumption
• Assumption of the duty to maintain safety during the period of use

The contract regularly contains the provision that the payment of security deposits and an advance payment in the amount of the expected license fee must be proven upon conclusion of the contract (prerequisite for the validity of the license). In the case of institutions that are exempt from the payment of a fee in accordance with Section 5, no security deposit is required. These institutions shall be obliged in the permit to remedy the damage they have caused within a reasonable period of time. In the event of breaches of the contract, the City of Bonn shall have the right to terminate the contract immediately.

Private charges are levied for the special use of urban green spaces for three groups of types of use:

1. Events by commercial users
2. Events by private users
3. Storage use

The fee is based on the fee tariff (Section 6).

The charge is levied per square meter or part thereof of floor space used and per day of the duration of the usage permit granted. An invoice will be issued for the final amount of the fee. Payment must be made to the Bonn City Treasury within 14 days of receipt. The debtor(s) is/are the applicant(s) in accordance with Section 3. Several applicants are jointly and severally liable. The place of performance is Bonn. To the extent permitted by law, Bonn shall be the agreed place of jurisdiction.

Charges are not levied for special uses:

1. which serve exclusively charitable, non-profit or ecclesiastical purposes within the meaning of tax law,
2. by local associations,
3. by the council and district councils, including their committees.

In addition, the Mayor of Bonn may, at his or her discretion, waive the charging of a fee in whole or in part if special uses beyond the scope of Section 1 sentence 3 are in the public interest to a special degree.

The absence or exemption from charges does not affect the necessary procedure in accordance with section 3.

The Terms of Use and Fee Regulations shall enter into force on the day following their public announcement.
