The prerequisites for the assumption of rent arrears are always:

• Application to the Office for Social Affairs and Housing for the assumption of rent arrears
• Notice of termination or
• notice of eviction or
• action for eviction
• Reasonable accommodation costs (see table)
• future rent payments must be secured (e.g. through benefits from the Jobcenter / Amt für Soziales und Wohnen / Arbeitsagentur)
• the landlord/landlady agrees in writing to the continuation of the tenancy, but installment payments are not possible or are refused by the landlord/landlady for understandable reasons
• the tenants remain in the apartment for at least another year after taking over the rent arrears, if possible
  in the apartment

Please bring the following documents with you to the agreed appointment:

from the landlord/landlady:

• current rent certificate with the current bank details of the landlord/landlady with IBAN and BIC
• current rent account statement showing a breakdown of the current rent arrears
• written confirmation from the landlord/landlady that if the rent arrears are accepted, the enforcement measures will be withdrawn and the tenancy will continue indefinitely.

from the tenant (if applicable):

• Tenancy agreement
• Notice of termination / action for eviction / judgment
• Current benefit statements from the Jobcenter / Office for Social Affairs and Housing, pension statement(s) or / and proof of income for the last three months of all persons living in the household
• Child benefit, housing benefit and parental benefit notices / maintenance advance notice / child supplement notice
• Widow's / orphan's pension certificates
• Care decree or legal representation decree
• Insurance policies, vehicle documents, statements of assets, savings books of all persons living in the household (assets are to be used primarily for repayment)
• Ordered, complete bank statements for the last three months from all persons living in the household
