At its meeting on March 26, 2015, the Bonn City Council adopted the following fee schedule on the basis of Section 41(1)(i) of the Municipal Code for the State of North Rhine-Westphalia in the version published on July 14, 1994 (GV. NW. p. 656/SGV. NW. 2023), last amended by the law of December 19, 2013 (GV. NW. p. 878) and Section 7 of the Bonn City Library Statutes of March 31, 2015:
§ 1: Customer base, customer ID
(1) Use of the city library is free. A customer card is required for borrowing.
(2) The customer card is issued upon presentation of a valid federal identity card, an electronic residence permit or a valid passport in conjunction with a registration certificate and after written acceptance of the applicable terms and conditions of use. With the acceptance, consent is also given to the electronic storage of the personal data required for booking purposes within the framework of the data protection regulations. The City Library must be notified immediately of any changes to the customer's address or name.
(3) In the case of minors, the legal representative is obliged to present the identity documents referred to in paragraph 2. In addition, in the case of minors, the legal representative must declare in writing that he/she is responsible for the minor's compliance with the conditions of use. The City Library must be informed in writing if consent is withdrawn.
(4) Legal entities and dependent institutions may use the City Library through persons who have been authorized in writing by their bodies or the respective institution's responsible body. The authorized person must accept the conditions of use in writing as amended from time to time.
(5) The number of loans per customer card may be limited by the head of the City Library for organizational reasons.
(6) The customer card must be presented for booking when borrowing books and other media.
(7) The customer card is not transferable. Its loss must be reported to the City Library immediately. The customer in whose name the card is issued is liable for any damage caused to the City Library through misuse. In the case of minors, the legal representative is obliged to pay compensation.
(8) The customer card must be returned immediately upon termination of the customer relationship (see § 9) or if this is required by the City Library for administrative reasons (e.g. issuing new cards).
(9) Processing receipts must be carefully checked and kept by the customer immediately upon receipt. Complaints can only be accepted on presentation of the relevant processing receipt.
(10) In order to use the personalized online services, a personal identification number (PIN) can be requested. The customer in whose name the card is issued shall be liable for any damage caused to the City Library through misuse of the personal identification number. In the case of minors, the legal representative is obliged to pay compensation.
§ 2: Existing use/rental traffic
(1) Borrowed media can be reserved at the electronic booking stations made available in the City Library, via the Internet and also in person by submitting an application.
(2) Media not borrowed from the stock of a City Library facility where the customer is not present at the time can be ordered at the electronic booking stations made available in the City Library, on the Internet and also in person by request (internal loan). The number of orders per customer card may be limited by the head of the City Library for organizational reasons.
(3) Books, periodicals and other media that are not part of the City Library's collection will be procured, as far as possible, via external loans. They can be ordered at the electronic booking stations made available in the City Library, on the Internet and also personally by request.
(4) The fees according to the fee schedule are processing fees that must be paid regardless of whether the medium is actually collected or not, or whether the medium ordered via external loan is available or may only be used on the premises of the City Library.
(5) Items intended for use on the premises of the City Library may only be borrowed with special permission from the library staff.
§ 3: Loan period
(1) The loan period is four weeks (28 days); it can be changed by the head of the City Library for certain types of media or media that are particularly topical or in justified exceptional cases. If the customer card is not blocked and no reservation has been made, up to two extensions of the loan period are possible on request in accordance with the loan period set for the respective type of media. The extension must be requested no later than the day on which the loan period expires. The head of the City Library may exclude certain media from the extension of the loan period.
(2) If the loan period is exceeded, late fees will be charged per day in accordance with the fee schedule for a maximum of 24 days. Mondays, Sundays and public holidays as well as Weiberfastnacht, Christmas Eve and New Year's Eve are not taken into account. The Head of the City Library may, in justified individual cases, disregard further days. Thereafter, the collection of media and fees will be initiated by the City Treasury of the City of Bonn. For each reminder (e-mail or letter) and written reminder, an additional flat-rate reminder fee will be charged in accordance with the fee schedule. The customer relationship is suspended in accordance with § 7 paragraph 3 in conjunction with. § 7 paragraph 1 letter a.
§ 4: General obligations of the user and the customer
(1) Every user or customer is obliged to store the books or other media, their supplements and the booking documents carefully, to treat them with care and to protect them from loss, soiling or damage. Damage also includes creasing and moistening pages, handwritten entries, underlining text passages, altering the content of audiovisual or electronic media and removing or altering booking features.
(2) Every customer must check the completeness and condition of the books or other media when borrowing them and report any defects immediately. Otherwise he/she shall be responsible for any defects found on return.
(3) It is not permitted to pass on borrowed books or other media.
(4) The user or customer is liable for loss of or damage to borrowed books or other media regardless of whether he/she is at fault. Compensation is to be paid in the amount of the replacement or repair costs. In addition, a one-off processing fee is payable in accordance with the attached fee schedule.
The customer relationship shall be suspended in accordance with § 7 paragraph 3 in conjunction with § 7 paragraph 1, letter b.
(5) Users or customers who suffer from a notifiable communicable disease within the meaning of § 6 of the Act on the Prevention and Control of Infectious Diseases in Humans or in whose home such a disease occurs are excluded from using the City Library for the duration of the illness. If they have borrowed books or other media, the City Library must be informed.
(6) No guarantee is given for the perfect technical and content-related condition of the media offered. No liability is accepted for consequential damage caused by technical defects.
(7) When using the media offered by the City Library, the legal provisions of copyright law must be observed. The user or customer is liable for any infringement of copyright.
§ 5: Fees
(1) Fees are charged for the use of the services of the City Library in accordance with the attached fee schedule, which is an integral part of this usage and fee schedule.
(2) The fees are due immediately. If, in exceptional cases, the fees not immediately paid by a customer reach an amount of 20 euros, his/her customer relationship shall be suspended in accordance with § 7 (1) (c). The fees will then be demanded by means of a fee notice after 30 days. The fee item with the oldest accrual date shall be decisive.
(3) If the fees are older than 90 days, the fees will be collected by means of a fee notice from as little as EUR 10 and the customer relationship will be suspended in accordance with Section 7 (3) in conjunction with Section 7 (1) (c). § 7 paragraph 1 letter c.
If the fees up to EUR 10 are older than one year, the customer relationship is also suspended in accordance with Section 7 (3) in conjunction with Section 7 (1) (c). The fee item with the oldest accrual date is always decisive.
(4) The head of the City Library may issue trial subscriptions with an exemption from the 3-month fee (tariff no. 1.6) in the form of vouchers for a raffle, for new citizens, for students in their first semester and for parents after the birth of a child within three months for advertising purposes.
(5) The head of the City Library may exempt volunteer employees of the City Library from all fees in individual cases.
(6) Kindergartens and schools are generally exempt from sections 1.5, 3.2, 4.0 and 4.1 of the fee schedule.
(7) Admission to events is charged in accordance with section 7.0 of the fee schedule. The head of the City Library shall determine the amount of the entrance fee on a case-by-case basis according to the following criteria
- Number of expected participants
- Size/equipment of the room/library
- Amount of the author's fee and ancillary costs
- Amount of materials required
- Intensity of the personnel costs
In justified individual cases of social hardship, she/he may also waive the fee in part or in full (e.g. for events to promote reading and reading skills or with a special local connection). The admission fees set in each case must be documented in a verifiable manner.
§ 6: House rules
The Head of the City Library issues site-specific house rules, which are posted in the library rooms.
§ 7: Suspension of the customer relationship
(1) The City Library may block the customer card
- until the overdue media have been returned (in accordance with § 3 paragraph 2),
- until the replacement costs or repair costs and processing fees have been paid in full (in accordance with § 4 paragraph 4),
- until full payment of the accrued fees (according to § 5 paragraph 2 or paragraph 3).
(2) The City Library may temporarily block the customer card, for a maximum of one quarter, if the customer does not fulfill his/her other obligations to the City Library in accordance with the house rules issued on the basis of § 6.
(3) In all cases under paragraphs 1 and 2, the customer relationship shall be suspended.
§ 8: Exclusion from use
If a user or customer grossly or repeatedly violates these Terms of Use and Fee Regulations or instructions issued to maintain orderly operations, he/she may be excluded from using the City Library.
§ 9: Termination of the customer relationship
The customer relationship ends when the customer
- declares his/her withdrawal,
- has been excluded from use in accordance with § 8.
§ 10: Entry into force
This schedule of fees comes into force on May 11, 2015.
