At its meeting on February 25, 2016, the Council of the City of Bonn passed the following resolution on the basis of Sections 3 ( 2), 26 and 52 (5) sentence 1 of the Act on Fire Protection, Assistance and Disaster Control (BHKG) of December 17, 2015 (GV.NRW. p. 885), as well as Section 7 of the Municipal Code for the State of North Rhine-Westphalia in the version published on July 14, 1994 (GV.NRW. p. 666/ SGV.NRW. 2023), last amended by the Act of June 25, 2015 (GV.NRW. p.496) and Sections 4 and 5 of the Municipal Tax Act for the State of North Rhine-Westphalia dated October 21, 1969 (GV.NRW. p. 712/ SGV.NRW. 610), last amended by the law dated September 8, 2015 (GV.NRW. p. 666), the following statutes have been adopted:
§ 1: Purpose of the fire prevention inspection
(1) The fire prevention inspection is carried out in order to preventively check whether buildings and facilities that are at increased risk of fire or explosion or in which a large number of people or considerable material assets are at risk in the event of a fire breaking out or an explosion meet the requirements of fire prevention.
(2) The inspection of fire prevention requirements serves to identify fire protection deficiencies and sources of danger and to initiate measures to prevent the development of a fire and the spread of fire and smoke and to enable the rescue of people and animals, the protection of material assets and effective extinguishing work in the event of a fire or accident.
§ 2: Official acts subject to charges
(1) Fees are payable for the services
- for carrying out the fire prevention inspection within the meaning of § 1, including its preparation and follow-up. This also applies in cases in which the department responsible for the fire prevention inspection is involved in inspections by the building supervisory authority and at the same time carries out a recurring inspection,
- as a result of necessary follow-up inspections (re-inspection) following defects identified during the fire prevention inspection in accordance with letter a),
- to carry out a fire safety inspection and its preparation and follow-up of an object that is not subject to the fire prevention inspection obligation or is not included in Annex 2, but has been requested verbally or in writing by the operator/owner of the object.
(2) The right of other authorities, in particular the building supervisory authority, to charge fees on the basis of special regulations remains unaffected if they have participated in the fire prevention inspection under their own responsibility or have taken action after the fire prevention inspection has been carried out.
§ 3: Scale of charges
(1) The fees are calculated according to the duration of the individual official act (including travel to and from the office) and the number of staff required. Travel costs shall be charged separately.
(2) The fees shall be calculated in detail in accordance with the provisions and rates set out in Annex 1 and taking into account the objects listed in Annex 2.
(3) Appendices 1 and 2 form an integral part of these bylaws.
§ 4: Timing of the fire prevention inspection
(1) The fire prevention inspection shall be carried out at intervals of no more than six years, depending on the degree of risk of the objects or facilities listed in Annex 2. For places of assembly and places of sale within the meaning of the Special Building Regulations, which are subject to periodic inspection by the Building Regulations Office in accordance with the NRW Inspection Ordinance, the interval shall be three years. For all other properties subject to periodic inspection in accordance with the NRW Inspection Ordinance, the interval is a maximum of six years.
In order to ensure continuity for the objects to be inspected, the inspection intervals for the fire prevention inspection are adjusted to those for the periodic inspection.
(2) Objects that have an increased risk potential due to their existing building fabric or due to local conditions may also require shorter intervals for the fire prevention inspection. The fire prevention department shall determine this at its own discretion.
§ 5: Debtor of fees
The party liable for the fee is the owner, holder or other authorized user of the property subject to the fire prevention inspection as well as the party applying for a service in accordance with § 2 Para. 1 letter c). Several debtors are jointly and severally liable.
§ 6: Exemption from fees
The following are exempt from paying fees
- Corporations, institutions and foundations under public law, provided the service does not relate to their commercial enterprises or a third party has not directly initiated the service;
- Institutions that exclusively serve non-profit or charitable purposes within the meaning of tax law;
- Churches and religious communities under public law if the service was provided for objects that directly serve the implementation of their church or religious tasks.
§ 7: Due date
The obligation to pay the fee arises upon completion of the official act. The fee shall be determined by notice. It is due within one month of notification of the decision.
§ 8: Entry into force
These Articles of Association shall enter into force on January 1, 2025.
The above statutes are hereby made public.
It is pointed out that a violation of procedural and formal regulations of the municipal code for the state of North Rhine-Westphalia (GO NRW) in the creation of these bylaws can no longer be asserted after the expiry of one year since this announcement, unless
- a prescribed approval is missing or a prescribed notification procedure has not been carried out,
- these Articles of Association have not been duly published,
- the Mayor of Bonn has previously objected to the resolution on the statutes or
- the formal or procedural defect has been notified to the city in advance, stating the violated legal provision and the fact that reveals the defect.
