- The following terms and conditions apply to the business relationship between Bonn-Information and participants in Bonn tours for individual guests on fixed dates.
- The reservation of city tours and sightseeing tours by customers can be made either verbally or in writing to Bonn-Information. The offer is based on the tour descriptions and the General Terms and Conditions stated here. The contract is concluded upon receipt of the declaration of acceptance of the reservation by Bonn-Information, which does not require any form. This means that verbal, telephone and electronic confirmations are legally binding in addition to written confirmations. Reserved tickets that are not collected will be invoiced to the customer.
- Different conditions apply to Tour A 1.
- Bonn-Information undertakes to conduct guided tours in all weathers, provided that the safety of the participants does not appear to be at risk. The decision as to whether there is a risk or not, and therefore whether a seasonal tour takes place or not, is made by the appointed tour guide on site.
- Arrival at the agreed time and meeting point is the sole responsibility of the customer. Bonn tours for individual guests start at the times published by Bonn-Information.
- In principle, no exact adherence to the route and schedule can be guaranteed for city tours and walking tours. We expressly reserve the right to make changes to routes and program points for factual reasons (e.g. traffic jams or roadworks). It may also be necessary to replace individual program or sightseeing points with others for objective reasons. Hazards may lead to the premature termination of a tour.
- The exchange or reimbursement of tickets is only possible in serious individual cases (e.g. in the event of illness at short notice on presentation of a medical certificate). Bonn-Information reserves the right to decide on the exchange or refund of tickets.
- If a guided tour is canceled, the costs for the tickets will be paid by bank transfer by the Bonn City Treasury.
- Reduced prices apply to children and young people from 12 to under 18 years of age, students, Bonn ID card holders and people with disabilities upon presentation of the relevant ID. Children under the age of 12 can attend free of charge. If a person with a disability is entitled to an accompanying person, the accompanying person's participation in the guided tours is free of charge.
- The contractual liability of the Bonn-Information for damages other than personal injury is limited to three times the total price of the service, provided that the damage was not caused by the Bonn-Information either intentionally or through gross negligence, or insofar as the Bonn-Information is responsible for damage incurred by a participating person solely due to the fault of an appointed vicarious agent. Bonn-Information shall not be liable for service disruptions in connection with services which, in addition to its advertised services, are merely arranged for the guest as third-party services.
- The current safety, distancing and hygiene concept of Bonn-Information applies at all times.
- The ineffectiveness of individual provisions shall not result in the ineffectiveness of the entire contractual conditions. Invalid provisions shall be replaced by the statutory provisions.
- The place of jurisdiction is Bonn.
For groups
Status: 2018
The following terms and conditions govern the legal relationship for guided tours between the customer and the tour guide.
1. conclusion of contract
The contracting parties are the customer and the tour guide (hereinafter uniformly referred to as the tour guide). Following a written, telephone or electronic inquiry, the customer shall receive a written confirmation of his inquiry with the essential contents of the contract, a current price list and these terms and conditions after the tour guide has given his consent. The contract between the customer and the tour guide is concluded when the confirmation signed by the customer is returned to the agent. If the customer subsequently wishes to make changes or additions to the agreed service, he must agree this immediately directly via the agent or with the tour guide. The agent shall forward such requests to the tour guide and respond to them on the latter's behalf. In such cases, additional costs may be incurred (see price list).
2. prizes
The prices in the price list valid at the time of ordering shall apply.
3. payment modalities
The fee for the city tour must be paid to the tour guide in cash at the latest at the end of the tour against a receipt. In the case of invoicing and foreign bank transfers, surcharges according to the current price list will apply.
If the customer's place of residence or business is abroad, the customer is obliged, at the request of the tour guide, to transfer the fee to the tour guide's account before the tour. The customer must ensure that the fee is credited to the account at least three working days before the day of the tour. If payment is not received on time, the customer is obliged to pay the tour guide in cash on the day of the tour, otherwise the tour guide is entitled to refuse to provide the service.
Entrance fees, parking fees, public transportation costs and other costs incurred by the group and the tour guide are not included in the tour guide's fee and must be paid by the customer to the service provider. The tour guide is entitled to charge a flat-rate reminder fee of EUR 10.00 for each reminder. The customer has the right to prove that a lower or no damage has occurred.
4. number of participants
The maximum number of participants for a walking tour is 25. The maximum number may be reduced for special themed tours. If the group size is exceeded, an additional tour guide must be hired.
5. delays
If guests are late, the tour guide will wait 30 minutes at the agreed meeting point. If guests are late, there is no entitlement to an extension of the tour or a reduction in the price. If the customer and the tour guide agree on an extension of the tour on site, the fee shall be increased by the price per extra hour according to the current price list. The customer must inform the tour guide of any delays as soon as possible using the tour guide's mobile phone number. If the tour guide is late, the customer can ask the agent to arrange another tour guide 15 minutes after the agreed time. In this case, the originally arranged tour guide is not entitled to a fee.
6 Cancellation
Cancellation of a tour after conclusion of the contract must be made in writing to Bonn-Information as the agent. Cancellation free of charge is possible up to and including 14 calendar days before the day of the tour. If an ordered guided tour is canceled less than 14 calendar days up to one day before the date of the tour, 70 percent of the tour guide fee must be paid.
Cancellations on the day of the tour or no-shows will be charged in full.
7. duties of care of the customer and guest
Participation in the guided tours is at your own risk and responsibility. In particular, guests are responsible for observing the traffic regulations. No duty of supervision is assumed for the participation of minors. This remains with the parents, legal representatives or accompanying persons.
In the case of sightseeing tours where the group arrives in its own bus, the customer must ensure that a seat with a seatbelt option and a microphone for the tour guide are available and that the bus driver has sufficient driving time to carry out the sightseeing tour. If no seat belt is available, the tour guide is entitled to refuse to conduct the city tour. The same applies if no microphone is available. Irrespective of this, the tour guide is still entitled to his fee.
8 Liability of the tour guide
The tour guide shall only be liable for damages resulting from an intentional or grossly negligent breach of contract by himself or his representative or vicarious agent. The limitation of liability according to sentence 1 does not apply to damages resulting from injury to life, body or health, which are based on a negligent breach of duty by the tour guide or a negligent breach of duty by his representative or vicarious agent of the tour guide. The limitation of liability according to sentence 1 also does not apply to such obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely. In the cases of sentence 3, however, liability is limited to foreseeable and contract-typical damages.
9 Applicable law, place of jurisdiction
The entire contractual and legal relationship between the customer and the tour guide shall be governed exclusively by German law, unless international or European regulations take precedence and are mandatory. If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for actions brought by the tour guide, in particular for damages or for payment of the agreed fee, shall be Bonn; the same shall apply to actions brought by the customer.
10. final provisions
The ineffectiveness of individual provisions shall not result in the ineffectiveness of the entire contractual conditions. In this case, the invalid provisions shall be replaced by the statutory provisions. Any other terms and conditions of the customer shall not apply unless they have been agreed in writing in the order. Image and sound recordings of the tour guide and recordings of the tour content are not permitted.
For the arrangement of guided tours
Status: January 2021
- The Bonn-Information arranges tour guides for interested individual guests and groups with the care of a prudent businessman. The contractual partners are the customer and the tour guide. The contractual relationship between Bonn-Information and the customer is governed by the following points.
- The customer accepts these terms and conditions when placing an order with the tour guide.
- Changes, additions and cancellations, in certain cases for an additional fee, are accepted by Bonn-Information as an intermediary and will be answered on behalf of and after confirmation by the tour guide.
- If the tour guide or a representative has not arrived at the meeting point within 15 minutes of the agreed tour time, Bonn-Information will endeavor to find another tour guide at short notice within the current office hours.
- Bonn-Information shall only be liable for damages, regardless of the legal grounds, within the framework of the statutory provisions of an intermediary, in the event of its own intentional or grossly negligent actions or those of one of its vicarious agents. This does not apply to damages resulting from injury to life, limb or health. Bonn-Information is not liable for services provided by the tour guide or third parties as part of a city tour or sightseeing tour (e.g. guided tours of museums, churches, places of interest, etc.).
- The current safety, distancing and hygiene concept of Bonn-Information applies at all times. We reserve the right to change the maximum number of people permitted on each tour depending on the situation.
- The ineffectiveness of individual provisions does not result in the ineffectiveness of the entire contractual conditions. In this case, the invalid provisions shall be replaced by the statutory provisions.
- The place of jurisdiction is Bonn.
